    • Records and paperwork

Regulation 8.2.1: Notwithstanding onsite staff documentation for application for employment, references, and written annual performance reviews from rule 3.4.5.1, the licensee shall maintain a legally notarized affidavit on site, signed by the licensee or designee, testifying that each staff file contains these records as required in the rule 3.4.5.1 of these regulations. The licensee shall permit representatives of the Division to have full access to off-site records to verify documentation.

“When the staff files were requested, Staff A indicated that staff files are kept at central office. Staff A said she did not know about whether there is a notarized affadavit in lieu of the files and referred Licensor [name] to the secretary in the main office. The secretary stated all staff files are at central office and she didn't know what a notarized affadavit was. Once explained to her what a notarized affadavit was, she stated they did not have that document. Corrective Action: Review staff files to ensure they contain all required documentation of this regulation. The program can choose to retain a copy of those files on site at the Elementary School, or have a notarized affidavit as stated in regulation 8.21. However, the program will also need to ensure that each staff person's quality and credential account through Bright Futures reflects staff's correct title for the position they are serving, their qualifications for their role in the program as well as reflect all annual professional development. If there are questions regarding what title to use, call Licensor [name] or the Licensor on Duty for assistance.”
