Regulation 6.2.6.1.2: In the event that the concerns cannot be resolved, written notice to the child's parent(s) is required with at least five (5) days' notice prior to expulsion.
“A review of messages between Bobbiesue Farrington and Child A's mother in the Brightwheel Child Care mobile app reflect that Child A's parent was not provided with a five day written notice of termination. The messages indicate that on 01/03/2024 Bobbiesue provided a two week writen termination notice because Child A's mother disclosed that she was looking for childcare elsewhere.Bobbiesue stated to this licensor during a conversation on 01/19/2024 that the termination was issued due to communication issues and the parent not returning medical documents required by licensing. However, Bobbisue does not provide these reasons when she informs Child A's mother of the termination.Instead the message states that since you(Child A's mother) are looking for another daycare consider this your written two week notice.Bobbiesue did provide messages that show Bobbiesue communicating with the parent and working through past communication issues. There were also several reminders sent to return the medical paperwork. Then on 01/05/2024 Bobbiesue sent Child A's mother a message stating that Child A was done at the program, because they (R and B Tiny Tykes) were being bashed on facebook and Child A's mother was the only parent having issues with the program. Bobbiesue states that [name], program co-owner, will drop off Child A's belongings off this weekend. This licensor was not provided with a copy of the Facebook post but was told that an aquaintance of Child A's mother put a post up stating she has a friend looking childcare in the Randolph area. There was a subsequent comment on the post where someone mentioned R and B Tiny Tykes and the poster responded that child was currently at R and B Tiny Tykes but it was not working out. Based on the messages from 01/05/2024, Bobbiesue did not provide a five day written notice of termination. This licensor has provided Bobbiesue with regulatory guidance in the past when situations occured where termination was required, this licensor has gone over this regulation in the past with Bobbiesue. Additional guidance was provided to Bobbiesue that termination for non threatening facebook posts is not an acceptable reason for termination and licensing requires that the provider implement a plan to address concerns before terminating care and that the written termination should be very clear with the reasons for termination and the steps the provider took to support the child's continuity of care. Corrective Action: Five day written notices are required when a childs care is terminated or a child is expelled from a childcare program. Please send this licensor a written statement attesting to the fact that you have reviewed section 6.2.6, the regulations related to termination/expulsion ,and that you understand the requirements of these regulations.”

Child A's diaper was pulled to the side. Loose bowel movement was covering Child A's legs and genital area. The gential area was exposed in the picture. Child A's parent was not aware this photo was shared. Provider stated she sent the photo to someone other than Child A's parent to show that a stomach virus was going through the program. Provider A did not provide guidance or positive behavior management as a response to the behaviors. Corrective Action: Provider B will provide mentoring for Provider A. Provider A was cleaning a highchair at the time, did not stop what they were doing and said, that is what happens when you go where you are not supposed to. Provider A did not check to see if either child received an injury or console them. Corrective Action: All children shall be attended to when they cry and shall be spoken to in a caring and age appropriate way.
