“Based on what was heard on the 11/29/2022 recording, there were no times during that day when the provider or assistant can be heard playing with the children, reading stories, providing art, music or science activities or any of the other requirements of this regulation. Corrective Action: Although unstructured play time is important for children the provider is required to have a daily curriculum which includes the bulletpointed items in this regulation. The provider and assistant shall be engaged with the children and providing them with different activites and learning opportunities througout the day.The corrective action for this violation will be included in a program improvement plan that will encompass all 8 violations cited. • Discipline and child guidance

Regulation 6.2.5.2: The FCCP and/or staff's expectations of children's behavior and responses to children's behavior shall be appropriate to each child's level of development and understanding. Guidance shall be designed to meet the individual needs of each child.

“During the 11/29/2022 recording, during nap time the assistant is heard saying the following to Child A who is 3 months old and crying, too bad boy I gave you a chance to straighten out. Child A can then be heard crying harder for about 15 seconds. Then the assistant is heard saying, and now I guess when you wake up you're going to be hungry right? Child A then starts crying harder again for a few seconds. The assistant turns the sound machine on and Child A quickly becomes quiet. Earlier in the day the provider can be heard yelling at Child B for upsetting Child C by closing the gate on them. The provider was heard yelling the following; I am done with that, you are not going to do that anymore. You do not get to shut people out. You want to do it then you can be on that side. Child B can then be heard crying and saying the providers name. The assistant can be heard calling from the other room asking what happened. The provider yells back that Child B keeps shutting the gate to make Child C scream, so I took Child C on this side and put Child B on the other and now she is having a hissy. Child B is two years old. Corrective Action: Guidance and expectations shall be developmentally appropriate. The corrective action for this violation will be included in a program improvement plan that will encompass all 8 violations cited. The program improvement plan will require completion of additional trainings, submission of documentation from the provider describing how non compliance with the regulations has been corrected and there will be an unannounced follow up visit with this licensor.”

    • Discipline and child guidance

Regulation 6.2.3.8: Nurturing activities performed by the FCCP and/or staff including diapering, toileting, feeding, dressing and resting shall be performed in a relaxed, reassuring and individualized manner that is developmentally appropriate and promotes the child's learning, self-help and social skills.

“On the 11/29/2022 recording the provider and assistant can be heard yelling at Child D for not being truthful about having a bowel movement in their diaper. The provider can be heard telling Child D that their lying makes her angry. The assistant can be heard yelling at Child D and asking why they keep lying about not needing to use the potty. The assistant then says, look at me, you got poop coming out of the back of you girl and you keep lying. Child D is then told to get on the potty and stop lying. In another interaction the assistant can be heard yelling at Child C while they are in the bathroom. When the assistant returns with Child C from the bathroom, the child is still crying. The assistant goes on to tell the provider how Child C acts like going poop is traumatic. At another time the provider can be heard yelling to the assistant, to get in here and change this kid, then says to the child your butt stinks. Based on what was heard on the recording, diapering is not done in a nurturing way that is developmentally appropriate and promotes a child's learning and self help skills. It is developmentally appropriate for young children, especially toddlers, to not always tell their caregiver when they need their diaper changed. It is not developmentally appropriate to yell at or call a child a liar as a reponse to a soiled diaper. Corrective Action: Children's toileting and diapering needs shall be handled in a nurturing, relaxed and reassuring way.

Regulation 6.1.4.4.5: Screen time shall not exceed thirty (30) minutes daily per child or group of children except for school age children using technology to complete homework assignments, and a once per month two (2) hour movie.

“Provider stated that the television is sometimes on in the morning during drop off but is usually only on for 30 minutes. According to the timestamp on the recording from 11/29/2022 the television was on for approximately 90 minutes. Disney characters could be heard as well as commercials. Corrective Action: Review this regulation and ensure that screen time requirements are met. Children under the age of 2 shall not participate in activities that involve screen time. The corrective action for this violation will be included in a program improvement plan that will encompass all 8 violations cited. • Discipline and child guidance

Regulation 6.2.3.10: The FCCP and/or staff's voices shall not dominate the overall sound of the group.

“Review of an approximately 8 hour audio recording taken in the providers Family Childcare Home on 11/29/2022, revealed dozens of times when either the provider or assistant raised their voice to address a child or children in an angry sounding tone and loud volume. At those times, their voices dominated the overall sound of the group. At one point after the provider was heard yelling at a child, another child can be heard telling the provider they have a headache. The provider responded by telling the child if they have a headache they should go find a quiet spot or go in the playroom. Corrective Action: The provider and assistant shall speak to children in a volume that does not exceed the overall sound of the group.

Regulation 5.2.3.1: The FCCP shall ensure that children's diapers are changed when wet or soiled.

“During the recording over 21 minutes go by after the provider first yells to the assistant who is in another room to come here and change these poopy diapers. Fourteen minutes then go by when the provider tells a crying Child C to go find the assistant. Child C does not go to find the assistant and six minutes later the provider now screams to the assistant, come get this kid, can you please come change her, please! It is unclear why the provider did not change this diaper and waited that long for the assistant to come. Registered homes are not required to have an assistant and the provider should have changed the diaper prior to 21 minutes passing. Corrective Action: Soiled diapers shall be changed in a timely manner.

Regulation 6.2.5.3: The FCCP and/or staff shall use positive methods of guidance and behavior management that encourage self-control, self-direction, self-esteem and cooperation.

“Throughout the 8 hour recording from 11/29/2022 there is only one time when the provider is heard positively interacting with the children and providing appropriate guidance. Those appropriate interactions were heard during drop off time in the morning when parents were present. The following are examples of the types of responses used by the provider and assistant when children were engaged in unwanted behaviors: you better get moving girl before I get ahold of you, get off me kid you are killing me, sit down, get off my couch, get your feet out of my face, how do you like it, I am done with that, I will deal with you later, knock it off, honestly stop, boy you look at me right now,get out of my way,God why don't you go play. When those statements were made, there was no follow up guidance provided. There are multiple occasions where children are yelled at for going into the providers desk or for jumping on the couch, when these behaviors occured the provider did not attempt to redirect with an acceptable alternative, like coloring or offering them an item that is ok to play with. There are no examples of the provider or assistant praising children or supporting self esteem and cooperation among the children. Corrective Action: The provider and assistant shall use positive methods of guidance and behavior management in response to unwanted or challenging behaviors. The provider and assistant will develop and utilize behavior management practices that allign with the requirements of this regulation.
