Regulation 2.3.1.5: The licensee shall not interfere with, impede, deter, provide false information or cause another to do any of the aforementioned, or in any manner hinder the Department or its agent(s) in an investigation or inspection.
“The Central Vermont Supervisory Union Pre-K Coordinator provided false or misleading information to the Child Development Division three(3) times over the past seven (7) months. On 10/01/2024 a violation was cited for regulation 3.4.5.4, the program opted to keep staff files off site and therefore must keep a signed, notarized affidavit on site, that confirms all staff files have been reviewed and contain the documents listed in regulations 8.2.1 and 8.2.2. This affidavit was not on site during that licensing visit. As a result of the violation the program was required to submit a notarized affidavit by 11/04/2024. On 02/13/2025 Licensing Supervisor [name] emailed an overdue corrective action notification to the Pre-K Coordinator. On 02/18/2025 the Pre-K Coordinator sent a copy of the affidavit that was dated 10/21/2024, but it was not notarized. At that time she also reported that new staff were recently hired and she would update the affidavit. On 09/23/2025 I conducted the yearly compliance visit and the Pre-K Coordinator was present and working in the Pre-K classroom. I asked her if I could see a copy of the affidavit. She stated she could not access it until 1 p.m. when the children left and did not believe the secretary would be able to locate it for me. I asked that she email a copy when she was done in the classroom. At 3:48 I received an email with the affidavit. It was dated 09/22/2025, the day before the licensing visit. The Notary Public listed on the affidavit is employed by the Central Vermont Supervisory Union. I called them on 09/24/2025 and asked them to confirm the date they signed the form. They stated they signed it yesterday, 09/23/2025. As a result I visited the central office on 09/26/2025 and showed the Notary Public the affidavit. I asked them why they notarized a form on 09/23/2025 but it was dated 09/22/2025. They stated that they received the form via email and the Pre-K Coordinator had signed and dated it. The Notary Public entered the same date, signed it and did not check to ensure it was the correct date. While at the central office I also requested access to the Washington Village Pre-K staff files, I was told the Pre-K Coordinator had them at the Northfield Elementary School. Shortly after I left the central office, the Pre-K Coordinator called me. She was told that I was looking for staff files and wanted to know if I needed to meet with her to see them. I informed her that I learned the affidavit was backdated and was notarized after my licensing visit. She stated that she must have made a clerical error and entered the wrong date. I asked her why she did not tell me that she had it notarized after I requested it. She stated that she knew the files were complete the day of the visit and did not think it mattered if she had the form notarized after I left. I explained that it did matter because the affidavit she provided me did not exist at the time the visit was conducted and if I had stayed at the school until she was out of the classroom she would not have been able to provide the affidavit. In addition to staff files, all Pre-K staff have a credential account in BFIS, licensing's online staff credential account. At the time of the visit there were five(5) staff members who did not have complete BFIS accounts. I asked the Pre-Coordinator to email me copies of the twelve(12) missing documents. Of the twelve(12) she provided four(4). Seperate violations were cited related to these missing documents and can be found in this report. This information proves that the Pre-K Coordinator did not have complete staff files but attested that staff files were complete on the backdated notarized form. Corrective Action: The Pre-K Coordinator will provide licensing with a written statement stating that all actions they will take moving forward will be upfront and factual. If this violation is cited again in the future additional licensing action and program monitoring may occur.”

It was also discovered that two (2) staff comfirmed to start working with the program as of the end of August 2023, but not present at the time of this visit, were not yet listed on the Associated Parties list.
