Regulation 6.2.6.4: When children are outside playing, staff shall be outside visually supervising the children.
“Nine children were left alone in the outdoor play area, while a staff member brought a child inside the building. The staff stayed inside for approximately five (5) minutes. Corrective Action: By 7/22/2026, submit a program improvement plan to Licensor [name] that details how supervision of the children will be maintained at all times and the steps that will be taken when a child needs to enter the building and staff are alone with the children on the playground. The plan should include internal training to educate existing staff as well as onboarding of new staff. Status: Under Appeal.”

Regulation 6.2.7.2: Staff's expectations of children's behavior and responses to children's behavior shall be appropriate to each child's level of development and understanding. Guidance shall be designed to meet the individual needs of each child.
“The written statements of two (2) staff and onsite video footage showed Staff A grab a child by the arm and pull the child in the direction the staff wanted them to go, raised the child to their face while holding their upper arms and speaking in a loud stern voice told the child to stop it, listen and sit down. As the child was trying to get up from the floor, staff A grabbed the child's arm and forcefully sat them back down. This is a serious violation. Corrective Action: Effective immediately, instruct staff to use developmentally appropriate expectations of children's behavior. By 7/22/2026 submit a program improvement plan to licensor [name] that states how the program will ensure staff's expectations and responses are developmentally appropriate to each child's level of understanding and that it meets the individual needs of each child. The plan shall include the program's trainings with all staff about positive guidance of children, providing ongoing observations of each staff member's work with children to ensure positive guidance and steps you will take to have staff bring forth concerns to the director immediately so that incidents like this do not repeat itself. A Parental Notification Letter, which is a copy of the licensing report, must be provided to each parent of every child enrolled within ten (10) days of the report submission. Provide a list of parent's names, child's name and contact information for each enrolled child. Status: Under Appeal.”

Regulation 7.2.2: The licensee shall ensure that all new staff and auxiliary staff, prior to working with children in the CBCCPP; and any new individual designated as the representative of the licensee shall submit a Records Check Authorization form to the Division and shall submit to fingerprinting at a location designated by the Division after having received the Fingerprinting Authorization Certificate by the Division.
“During the visit I identified a staff member who was not listed on the associated parties and therefore a record check authorization form had not been processed by the Child Development Division and they were not approved to work at the program. Director confirmed she did not submit a record check authorization form, the staff member just started working at the program as they were short staffed. During the visit I did not observe this staff member alone with children and noted that other staff were aware that they did not have clearance to be left alone with children, Corrective Action: Since the visit the director submitted the record check authorization form and the Child Development Division processed and approved them to work in the program. They may not be left alone with children until they complete fingerprinting and the Child Development Division issues a clearance letter. Please schedule a fingerprint appointment and email a copy of the receipt. Moving forward ensure record check authorization forms are submitted for new staff and they are reflected on the program's associated parties list before they work at the program.”
