    • Supervision and ratios

Regulation 6.2.4: Supervision of Children The FCCP and/or staff shall ensure visual supervision of children except as allowed in rules 6.2.4.1 - 6.2.4.4 of these regulations.

“As I drove up to the home, I observed Fatima in a garden next to the garage. When she observed me in the driveway she entered the door at the back of the garage and came to the door at the front of the garage and greeted me. When asked she stated she did have children in care. When I entered the home I observed six(6) children sitting at a table eating lunch. There were no adults present in the space. The ages of the children present were three(3) to five(5) years old. Regulations require that when children are eating the provider is positioned to allow for visual supervision and is able to immediately physically respond in a choking incident. While the provider was outside she was not able to hear, see or physically respond in the case of an emergency. This is a serious violation. Corrective Action: Review regulations 6.2.4.1-6.2.4.5.Please complete a program improvement plan that explains how your practices moving forward will ensure compliance with the regulations related to supervision. All parents will be provided with a copy of this site visit report, the report will be posted in a location visible to parents within the home. Since the visit I requested the parent contact information and Fatima has provided that.”

    • Building, equipment and play areas

Regulation 5.10.3.3: Safe Use Zones For all play equipment that is thirty (30) inches or higher from the ground, including climbing equipment, slides, swings and other similar equipment, the FCCP shall ensure that the surface under and around the equipment, included recommended use zones, is of approved resilient material that protects children if they fall. * Materials in the use zone shall consist of wood chips, pea stone, mulch, engineered wood fibers, sand, safety-tested shredded or rubber like material or rubber mats designed for protective cushioning; * Materials used in the use zone shall follow the recommendations listed in the most recent publication of U.S. Consumer Product Safety Commission's Public Playground Safety Handbook regarding critical depth of tested materials determined by the height of the highest climbing surface of the equipment; * Materials used in the use zone shall be installed and maintained according to the manufacturer's instructions; * If the loose material such as sand, mulch, or shredded rubber is used in use zones, the FCCP shall ensure that the material is raked regularly and replenished to maintain depth and resilience; and * If the resilient material in use zones freezes, the FCCP shall ensure that the children will not play on the equipment until the resilient material has thawed and is once again resilient.

“It was observed that the program has three (3) types of swings at the program, where children can achieve a height of thirty (30) inches or more. No cushioning materials were present under the swing equipment as required. Corrective Action: Effective immediately, make the swing equipment inaccessible until proper cushioning material can be installed. It is required to review the Public Playground Safety Handbook to determine how much cushioning material is required. Send a detailed plan of compliance to this licensor by 11/29/2021 that outlines how the program plans to come into compliance with cushioning materials.”
