Regulation 6.3: The staff/child ratio shall not exceed 1:13. When the number of children exceeds 10, another identified Staff person shall be available within immediate proximity on site in order to provide prompt assistance in the event of an emergency.

“During a visit on 03/17/2022, Staff A was alone and responsible for the supervision of 21 children for approximately 20 minutes in the gymnasium. 10 of those children were listed as Math Club participants, a club that is not part of the licensed afterschool program. Based on discussions with staff, this occurs every Thursday as Staff B is unable to arrive when the program starts. Staff B usually arrives between 15 and 30 minutes after the program starts. Licensor [name] made the following observations while Staff A was supervising on her own: children left the gymnasium without Staff A's knowledge, exiting through the open exterior door to chase a ball that had rolled out of the gymnasium. The ball rolled out the door as a bus was pulling into a spot next to the exit door.Staff A did notice what happened after about 2 minutes, Licensor [name] maintained visual contact until Staff A intervened. While Staff A was trying to pass out snack, many children were engaged in risky play which included climbing on the metal bleacher railings with an estimated fall height of 6 feet, climbing inside of milk crates that were stored on the stairs near the stage, older children teasing younger children by hiding in a storage closet and opening and shutting the door as the children approached, play was unstructured and resulted in children throwing balls at each other and in an uncontrolled manner, this licensor was hit twice by flying balls and once by a Beyblade( a plastic spinning top toy), many children were walking and running around while eating their snacks. Staff A was not able to adequately supervise all areas of the gymnasium and maintain control as a direct result of the 1:21 adult/child ratio. Corrective Action: Effective immediately the program shall ensure that proper adult/child ratios are adhered to. Effective immediately program staff may not provide supervision of children who are not enrolled in the program.”

“During the visit it was noted that the gymnasium door was open and children were able to come and go between the outside space and indoor space. Communication between the staff member inside and the 2 staff members outside to discuss how many and which children were in each space was not observed. A staff member, supervising outside, was asked how many children were present as this licensor was unable to get an accurate count due to children moving between spaces. This staff person stated they would need to check the attendance sheet as she was not sure. This staff person was identified as the acting director of the site. The attendance sheet was reviewed and it was noted that 14 children were present at the time the question was asked. Corrective Action: Staff shall know how many children are in their group and will communicate with other staff members when children enter or leave a space.
