“Based on evidence gathered a child under the age of 10 years old was not within actual sight and sound supervision of staff for a period of minutes on 2/21/24. Evidence: 1. At approximately 8:40am, Staff #3 left the gym with a group of children, to return to the SACC classroom, and left Child #10 in the gym bathroom. 2. Approximately 3-5 minutes later Child #10 returned to the SACC classroom unaccompanied by staff and emotionally stated "You left me in the bathroom." 3. Staff #1, Staff #2 and Staff #3 observed Child #10 return to the SACC classroom alone. 4. The less than 1 minute walk from the gym to the SACC classrooms goes through a lobby area and turns down a hall. There is no direct sight from the SACC classrooms doors to the gym doors. The gym has exterior doors to the outside of the building. 5. The written incident report and staff written statements, including that of Staff #3, do not indicate that children were counted before leaving the gym or after returning to the classroom. 6. Child #10 is 9 years-old.”
