    • Supervision and ratios

Regulation 6.2.1.3: The program director shall ensure that the number of staff present meets requirements described in the chart below for ages of children, maximum group size, and staff/child ratios at any time of day.

“Upon arrival at the program this licensor observed Staff A standing next to a vehicle in the parking lot vaping. Staff A was counted in ratio at this time and left one (1) staff person with the group of thirteen preschool children. The staff to child ratio for this age group is 1:10. This is a serious violation. Corrective Action: Ensure ratios are always maintained, to include when staff take breaks. Review this requirement with all staff and identify how breaks will be covered while maintaining ratios, and the actions staff will take if they identify ratios have not been maintained. A Parental Notification Letter (PNL), which is a copy of this licensing report, must be provided to each parent of every child enrolled within ten (10) days of the report submission. Provide a list of parent's names, child's name and contact information for each enrolled child. Email the parent contact information to Licensor [name] Irwin. Status: Under Appeal.”

    • Other rules

Regulation 4.3.2: Parents may request a formal or informal meeting with the program director or CBCCPP staff with primary responsibility regarding their child at any time and any such request shall be accommodated within ten (10) business days of the request.

“A review of written communication between the program director, Staff A and the parent of a child in care revealed that in February 2023, approximately 10 weeks after enrolling their child, a parent mentioned a desire for a meeting with Staff A, who was the child s lead teacher. Staff A responded to the message with other requested information, but no meeting was offered. A few days later, the program director received an email from the same parent requesting a meeting. The director s email response indicated that the child had not been in care long enough to have a conference and that formal conferences would be held for all families in April 2023. During an interview, Staff A stated that they had a verbal check-in with the parent who was again requesting a time to meet. Staff A stated that they reiterated the director s message that the child had not been with the program long enough to have a full conference. The parent then wrote a message to Staff A including questions about their child s interaction while in care. Staff A responded with a brief statement confirming the child s normal development. The Director stated that the last statement in the initial email response to the parent indicated the parent could request a conference at any time and that the parent did not make another request. This indicates that the parent would be required to make several requests in order to have the request honored. The parent, Staff A and the director confirmed that the child had a difficult transition into the program. A parent-teacher conference was held for the child on April 28, 2023. This does not meet the requirements of this rule. Corrective Action: Immediately plan to accommodate any request for a meeting or conference from any family within ten (10) days of the initial request, regardless of how long a child has been enrolled or any other circumstance. Immediately plan to have written communication with all staff and enrolled families to make them aware of the program s requirement to accommodate a parent s request for a meeting/conference within 10 days of the initial request. This written communication shall be provided to all staff and families and Licensor [name] no later than 08/21/2023. Further, plan to revise communication policies in the parent and staff handbooks to clearly and properly address these policies including: 1. Assurance that families have the right to access their child(ren) s classrooms, their child(ren) s assigned staff members without prior notice, and their children s files upon request, 2. information about the staff requirement to have consistent, positive, 2-way communication with families, 3. information about the requirement for staff to honor any request for a meeting or conference within ten (10) days of the initial request and the process for ensuring that it takes place as planned moving forward. Submit those revisions to Licensor [name] for approval by 08/25/2023. Continue to work with Licensor [name] until you have been notified that the revisions have been approved by the Division. Upon approval from the Division, plan to make those handbook revisions available, with an explanation of what has been revised, to all staff and families in a timely manner and by a date agreed upon by the Director and Licensor [name].”

    • Staff training and qualifications

Regulation 7.1.2.2: Staff who are counted in the staff/child ratios and auxiliary staff left alone with children and/or counted in staff/child ratio as specified in the rule 6.2.1.8 of these regulations shall obtain training in pediatric first aid and in infant and child CPR within three (3) months of beginning work in the CBCCPP and remain currently certified.

“A review of staff files and staff BFIS quality and credential accounts reflected that Staff A and Staff B had not maintained certifications in infant and child CPR and pediatric first aid. Staff A's previous certifications had expired on 12/09/2022 and had not been renewed. Staff B's previous certifications expired on 12/29/2022 and had not been renewed. Corrective Action: Immediately plan to have Staff A and Staff B complete certifications in infant and child CPR and pediatric first aid and submit the documentation of completion to Northern Lights at CCV(NLCCV) by 03/09/2023. If you need assistance locating approved CPR and first aid trainings, you may reach out to your NLCCV resource advisor, Adi Taylo-Behrman at 802-654-0730 or adri.taylo-behrman@ccv.edu. Develop a system which will prompt you and/or staff to sign up for CPR and first aid certifications in a manner which will ensure that every staff member remains currently certified. Include a description of your system, who will be responsible for developing the system, alerting staff of upcoming due dates, and ensuring follow through with certification completion and submission of documentation to NLCCV.”
