    • Building, equipment and play areas

Regulation 12.14: Cushioning material which is absorbent shall be in place under climbers, slides, swings, or other structures which allow children to achieve a height of more than thirty inches. The depth of surfacing materials shall be appropriate to the height and use of the equipment as outlined by the Consumer Product Safety Commission's National Playground Safety Standards (see Appendix B). Surfacing material shall be maintained in good condition. Grass, bare ground, asphalt and concrete are prohibited under these structures. If weather conditions make the use of equipment unsafe, Staff shall keep children off of the equipment.

“During outside time, a total of 17 children were observed to use the swings and the large climbing structure which allow children to reach a heght of 30 inches or higher. The ground under and around the swings and climbing structure was covered with snow and ice. Corrective Action: Immediately plan to bar access to any equipment which allows children to reach a height of 30 inches or higher when weather conditions impact the resiliency of the cushioning materials under and around the equipment. Develop a system which ensures that: 1. staff are aware of this requirement, 2. staff are checking the playground cushioning for depth and resiliency before allowing children to utilize any equipment which allows them to reach a height of 30 inches or higher moving forward.”

    • Background checks

Regulation 5.14: The licensee shall ensure that no person shall be left alone with children without approval from the Division which shall be based on the results of the background check to include fingerprinting.

“Upon arrival at the program, Staff A was supervising 3 children at the bathroom, which was not within earshot or eyesight of any of the other staff. A review of Staff A's BFIS quality and credential account reflected that Staff A had not yet received approval to be left alone with children from the Division based on the results of the fingerprint supported background check. While the children were outside on the playground, Staff A was asked by the Director to take another child inside to use the bathroom without the supervision or assistance of another approved staff. Once notified by this licensor that Staff A did not have approval to be left alone with children, the Director took the child inside to use the bathroom. Corrective Action: Immediately plan to ensure that no staff be left alone with children until receiving approval from the Division based on a fingerprint supported background check. Develop a system which will ensure that: 1. All Directors are aware of the requirement for all staff to receive approval from the Division prior to being left alone with children, 2. All directors are receiving clear communication from upper management about when a staff is cleared or not cleared to be left alone, 3. all staff are submitting to fingerprinting and/or out of state records check requirements in a timely manner upom hire and at least once every 5 years thereafter, and following up with the fingerprinting station, the other state(s) in which they have resided, and/or the Child Care Business Technician when clearances are not returned as expected, 4. all staff are supported through this process and supervised by a fully cleared staff member until such a time when they have received the final clearance letter moving forward.”
