Regulation 5.1.2: General Health Examinations: Within forty-five (45) days of enrollment, the licensee shall obtain documentation of the child's age appropriate well care exam from the parent. Documentation shall include information regarding any health conditions and medications that may impact the care of the child.
“A review of seven (7) individual children's files reflected that four (4) files did not contain General Health Exam forms. The Director confirmed that they were not aware of whether or not the forms had not been submitted and that a new system for collecting the forms needed to be developed due to a change in leadership for the school. Corrective Action: Immiediately plan to review all children's files for completion and to collect any outstanding forms and information required by 01/15/2022. Develop a system which will prompt you/ and or other staff, to collect the General Health Exam Form for each child within 45 days of enrollemnt moving forward. Include details of who will be responsible for notifying parents of this requirement, how parents will be notified and when, how reminders and follow-ups will occur until such a time when all forms are collected, and where the forms will be stored moving forward.”

Regulation 5.10.3.3: Safe Use Zones For all play equipment that is thirty (30) inches or higher from the ground, including climbing equipment, slides, swings and other similar equipment, the licensee shall ensure that the surface under and around the equipment, including recommended use zones, is of approved resilient material that protects children if they fall. * Materials in the use zone shall consist of wood chips, pea stone, mulch, engineered wood fibers, sand, safety-tested shredded or rubber like material or rubber mats designed for protective cushioning; * Materials used in the use zone shall follow the recommendations listed in the most recent publication of U.S. Consumer Product Safety Commission's Public Playground Safety Handbook regarding critical depth of tested materials determined by the height of the highest climbing surface of the equipment; * Materials used in the use zone shall be installed and maintained according to the manufacturer's instructions; * If the loose material such as sand, mulch, or shredded rubber is used in use zones, the licensee shall ensure that the material is raked regularly and replenished to maintain depth and resilience; and * If the resilient material in use zones freezes, staff shall ensure that children will not play on the equipment until the resilient material has thawed and is once again resilient.
“During the visit, it was observed that several children were allowed to climb and play on the large playground structure which allows children to reach a height of 30 inches or higher. The outside temperature during the visit was approximately 26 degrees F. The cushioning material under and around the structure was unable to be moved or measured due to being frozen and covered with snow. Therefore the cushioning material was no longer resilient. Corrective Action: Immediately plan to bar access to the large playground structure and any other structure which allow children to reach a height of 30 inches or higher until such a time when the cushioning materials have thawed and been measured to ensure proper depth per the guidance of the U.S. Consumer Product Safety Commission's Public Playground Safety Handbook. You may find the U.S. Consumer Product Safety Commission's Public Playground Safety Handbook by following this link: https://www.cpsc.gov/s3fs-public/325.pdf. Develop a system which will prompt you and/ or other staff to routinely check the cushioning materials for proper depth and resiliency and to take the proper action given the findings. Include details of who will be responsible for checking and assessing the cushioning materials, how often the materials will be assessed, who will be responsible for reporting any needs for repair or replacement, who the needs will be reported to, who will ensure follow-through of the repair or replacement needed, how the equipment will be made inaccessible to children until it is the proper depth and assessed to provide proper resiliency, and how all staff will be made aware of these requirements moving forward.”

Regulation 3.4.6.5: Staffing Schedule: A licensee shall maintain a written record of the daily schedule for at least 365 days of all staff including exact days and hours worked and the group of children to whom they are assigned.
“Staff A was not able to identify a staffing schedule or staffing attendance system which would meet the intent of this rule. Staff A stated that currently the preschool staff are aware of which rooms they are assigned to and when, but could not recall a time when there had been a system for documenting the details of staffing as required by this rule. Corrective Action: Immediately plan to create an electronic and/or hard copy staffing schedule which documents the details required by this rule. Develop a system that will ensure electronic or hard copy staffing schedules are maintained accurately, including staff absences, substitute schedules and the schedules of any program support staff for a minimum of 365 days moving forward.”

“A total of seven (7) child files were reviewed. Files for Child A, B, C and D did not contain signed General Health Exam documents. Child A, B, C and D had been enrolled for more then 45 days. Corrective Action: Immediately plan to review all children's files and to collect signed General Health Exam forms for Child A, B, C and D and for all enrolled children by January 1, 2021. Corrective Action: By 12/31/2019, begin to practice evacuation drills at least once a month and submit a program improvement plan to this licensor to ensure that the evacuation drills are conducted at least once a month and a written record maintained as outlined in rule 3.4.6.1”
