    • Safety and hazards

Regulation 5.10.3.1.6: The outdoor play area shall be free of dumpsters, uncovered trash cans, highly flammable materials, standing pools of water and other hazards. Staff shall inspect the outdoor play area before children begin to play to make sure there are no hazards present such as, but not limited to, animal feces, litter, adult tools, or other items that might injure a child.

“This licensor observed duck and chicken droppings in multiple locations within the outdoor space used by the children. The Director stated droppings are not removed from the ground in the duck pen before staff and children enter the space. Droppings were also seen on the concrete walkway entering the building, some droppings were flattened and appeared to have been stepped on. Some of the droppings appeared fresh while others looked dried up or flattened to the ground. The Director stated they were not aware that the droppings should be picked up each day before children utilize the outdoor space. Corrective Action: The Director stated that additional fencing is on order and once it is installed the ducks/chickens will no longer wander in the space used by the children. Until the fence is installed the duck/chickens will remain in their current fenced space. Review this regulation with all staff members. Create a plan that identifies what steps will be put in place to ensure compliance with this regulation is maintained. The Director will identify how they will ensure staff are conducting a daily inspection of the playground/outdoor areas prior to children entering the space. Email a copy of the plan to Sara.Fitts-Pratt@vermont.gov by the corrective action due date.”

    • Discipline and child guidance

Regulation 6.2.7.3: Staff shall use positive methods of guidance and behavior management that encourage self-control, self-direction, self-esteem, and cooperation.

“Two staff took a group of children on a walk in the local neighborhood. While on the walk Staff A became frustrated with a child's behavior and yelled at them in a loud voice and said "Stop! I am sick of that behavior!". Corrective Action: The program met with the staff and implemented an Educator Support & Improvement Plan. The program will continue with approved plan to support, mentor and educate staff with appropriate guidance practices, mindfulness of tone and support with transitions. Send an email with an update of the plans progression by 12/19/2025.”
