Regulation 5.12: The licensee shall ensure that all new staff prior to working with children in the Afterschool Child Care Program; and any new individual designated as the representative of the licensee shall submit a Records Check Authorization form to the Division and shall submit to fingerprinting at a location designated by the Division after having received the Fingerprinting Authorization Certificate by the Division.

“Staff Person A present during this visit and reported to be working daily at the program for the 2023-2024 school year has not completed the required fingerprint clearance. The program was notified of this requirement when the record check was processed for this person in 2019. This is a repeat violation. The program was cited for failing to have fingerprints processed for different individuals during a compliance visit in 2023. Corrective Action: As explained to Staff Person A during the visit, this person may not be left alone with children until fingerprint clearance approval has been sent to the program. Have Staff Person A have their fingerprints processed at an approved fingerprint processing location. Ensure the individual uses the fingerprint authorization form from the Child Development Division website. Send either paid receipt for the processing or the fingerprint processing confirmation receipt to Licensing Field Specialist Crawford. Develop a plan that identifies who is responsible and how that person will monitor the background clearance process to ensure completion of this requirement in a timely fashion.”

    • Discipline and child guidance

Regulation 9.1: Staff shall use positive methods of guidance that meet the individual needs of each child and encourage self-control, self-direction, self-esteem and cooperation including: * redirection * planning ahead to prevent problems * reinforcing and praising appropriate behavior * encouraging children to express their feelings and ideas instead of solving problems with force.

“A nine year old child was instructed to "sit out" at the picnic table for his second incident of jumping off the swings. Staff person, Dan who had set the requirement did not discuss nor approach the child while the child was seated at the picnic table. The child was heard telling an agemate "I am expelled". The group transistioned back inside the building without any resolution. During inside snack preparation and handwashing, a kindergartner was requried to sit at a school desk which faced the wall after he had been turning over stools in the room and running in the program space. When asked about this intervention, staff stated that the child would be required to sit at the table for a couple of minutes until the child was told to get up by a staff person. Corrective Action: Neither example of staff intervention involved positive guidance techniques nor were designed to instruct the child on acceptable alternatives. Submit a program improvement plan to elaine.crawford@vermont.gov that outlines the appropriate guidance techniques staff shall employ with the varied ages and developmental abilities of the children in the program. A copy of this plan shall be sent to elaine.crawford@vermont.gov by 11/20/2016”

“The black landscrape fabric protruding through the cushioning material creates a tripping and/or fall hazard for at least two of the swings.
