    • Supervision and ratios

Regulation 6.2.6.1: Staff shall be able to hear all children of pre-kindergarten age and younger at all times, shall be able to see the children with a quick glance, and shall be able to physically respond immediately.

“On 1/16/2024, a child was found at the end of the hallway on the first floor, by the door alone. The child had walked out of their classroom during toileting/diaper changing time. Staff were unaware the child had been missing for up to two minutes. In addition, on the date of 6/13/2023, the program self reported a similar incident and the Division did not cite a violation at that reported time. A violation is being cited at this time as there is now a pattern of a break down in supervision. This is a serious violation. Corrective Action: Submit a program improvement plan that will identify how the programs systems and supervision protocals will be reviewed and updated. The plan will describe how staff supervision practices will change to ensure that children are accounted for during transitions. By 3/26/2024, mail or email the parent notification letter as outlined above and submit the list of parents, their contact information and who received the parent notification letter to this licensor.”

    • Discipline and child guidance

Regulation 6.2.7.2: Staff's expectations of children's behavior and responses to children's behavior shall be appropriate to each child's level of development and understanding. Guidance shall be designed to meet the individual needs of each child.

“Staff X brought four children inside to use the bathroom. One of the children refused to put back on their outdoor winter clothing, including boots, before returning outside to the playground. Staff X brought the four children back outside and onto the sidewalk while carrying one of the children's outdoor winter clothing and boots, and had the child walk with no shoes or boots on. Staff X talked to Staff Y for at least 30 seconds to two minutes, while the child screamed that their feet were cold and were hurting. Staff Z, on an adjacent playground, went and spoke to Staff Y of their concern of the child being outside without boots on and asked for Staff X to pick up the child. Staff X offered the child their boots, but the child refused, and Staff X did not pick up the child. Staff Y decided to bring all the children inside. Staff X had the child walk back inside. Making a child walk outside without boots and outdoor clothing on in the wintertime is not an acceptable response to a child's behavior and development. Corrective Action: It is required to develop a Program Improvement Plan that identifies a specific training, and the date the training will be conducted on the topic of positive guidance practices. The Program Improvement Plan will describe how staff will receive support in improving positive guidance practices and how the Director will supervise staff to ensure practices are effectively implemented and maintained.”

“There are three staff present who have not submitted to the required fingerprint supported background check. Corrective Action: Have the three staff schedule appointments for fingerprinting. Ensure that they are not left alone with children until their fingerprint results have been received by the Child Development Division. Submit confirmation of scheduled appointments to this licensor.”

    • Safety and hazards

Regulation 3.7.2.2: The licensee shall ensure that evacuation drills are conducted at least once a month, and children and staff are evacuated in under three (3) minutes. Licensees of a CBCCPP located within a public or independent school building may count a lock-down drill performed while the CBCCPP is in operation in place of a monthly evacuation drill with the CBCCPP children and staff and at least three (3) of the monthly drills conducted within 365 days shall be evacuation drills.

“The evacuation drill record reflected that drills were not conducted in October and November of 2022. Corrective Action: In January and February 2023, complete two evacuation drills each month. In March 2023, resume completing one evacuation drill a month. Create a system to ensure the completion of evacuation drills as required.”

    • Staff training and qualifications

Regulation 7.1.3: The licensee, in consultation with the program director, shall establish written program policies and procedures and provide these to staff and to auxiliary staff left alone with children and/or counted in staff/child ratio as specified in the rule 6.2.1.8 of these regulations during an orientation training session approved by the Division prior to being left alone with children. Trainees under eighteen (18) years of age and other staff not left alone with children shall complete the orientation training within at least one (1) month of their first date of working with children. Complete written information and the orientation training session shall include: Basic knowledge of child growth and development; Routine and emergency health protection of children including health related exclusions; Safety and sanitation requirements including handling and storage of hazardous materials and disposal of bio contaminants; Positive behavior management; Supervision of children; Child accident and injury procedures including building and physical premises safety; Safe sleep practices; Administration of medication requirements; Emergency and evacuation requirements; Nutrition and food safety including prevention of and response to emergencies due to food and allergic reactions; Recordkeeping; Transportation and child passenger safety; Release of children; Respectful engagement of families; Preventing, recognizing, and reporting child abuse and neglect; including information about the signs and symptoms of sexual abuse, sexual violence, grooming processes, recognizing the dangers of child sexual abuse, and other predatory behaviors of sex offenders; Recognition of and response to the symptoms of common childhood illnesses; Preventing the spread of infectious disease; Providing developmentally appropriate activities and experiences for children; Inclusion of children with special needs; Guidelines for volunteers, partner staff, auxiliary staff, and business managers; Responsibility to comply with current applicable licensing regulations; Staffing requirements to include opening and closing; and Ensuring children have extra clothes and diapers available.

“An audit of BFIS Quality and Credential Accounts and on site staff files show that Staff A and Staff B, who have been employed for over 30 days, have not completed an approved orientation training as required. • Safe sleep

Regulation 5.4.2.3: Staff shall ensure that infants sleep in cribs or port-a-cribs. Infants shall not be placed to sleep on soft surfaces, such as a couch or sofa, pillow, quilts, sheepskins or blankets. Infants shall not be placed in car seats, swings, high chairs, jumping chairs or similar equipment for sleep. A child that falls asleep in this type of equipment shall be gently transferred to a crib or port-a-crib as soon as feasible.

“Staff stated an eleven-month old infant in the Koala Bear classroom has been sleeping on a nap mat and the infant had not attempted to climb out of the crib prior to transitioning to the nap mat. Infants under the age of 12 months are to sleep in a crib or port-a-crib unless able to climb out on their own. Corrective Action: Effective immediately, infants under the age of 12 months shall sleep in a crib of port-a-crib, unless they are able to climb out on their own. By 3/25/2020, submit an improvement plan on how the program will ensure infants under 12 months of age nap in a crib or port-a-crib, unless able to climb out on their own.”

    • Supervision and ratios

Regulation 6.2.6.1: Staff shall be able to hear all children of pre-kindergarten age and younger at all times, shall be able to see the children with a quick glance, and shall be able to physically respond immediately.

“On February 6th, 2020, two staff in the Koala Bear classroom were sitting on the floor in the play area with five infants while three infants slept in the nap area. Two infants were in cribs and one was on a mat on the floor. Staff could not see the infant sleeping on the mat because of the closed solid gate and wall that is three feet in height separating the nap area from the play area. An eleven-month old infant sleeping on a mat woke up, left the classroom which had an open door and gate, and was found by a staff member of another classroom in the hallway approximately two feet from the entrance to the restroom. Staff stated the time the infant left until the time the infant was found in the hallway was between 11:05 and 11:10. Staff stated they were not aware the infant had woken up and left the room. The door to the classroom was closed and the gate was open when the infant was found in the hallway. Because staff were not able to see the sleeping infant on the nap mat on the floor in the nap area, were not aware the infant woke up, left the classroom, and was found in the hallway near the restroom, this is a lack of supervision. This is a serious violation. Corrective Action: By 3/25/2020, mail or email the parent notification letter as outlined above and submit a list of all parents who were sent the parent notification letter and their contact information to this licensor. Effective immediately, staff shall maintain visual supervision of children who are sleeping on nap mats. Submit an improvement plan on how staff will implement this practice and how the program will ensure children sleeping on nap mats are visually supervised.”

    • Safety and hazards

Regulation 5.10.5.4.7: The program director shall develop a written aquatic plan that addresses supervision and safety of swimming activities. This plan shall have a table of contents and plot plan for any swimming facility in use by the program indicating where first aid is to be practiced and where emergency equipment is to be placed. The plan shall be: * Reviewed once every 365 days; * Updated as needed; * Known by all staff present at the swimming facility; * Kept on file at the facility with a copy available while swimming occurs; * In the case of off-site swimming locations, the plan is formulated in conjunction with off-site aquatics personnel; and * Available for review.

“As the school age classes were preparing to leave the center to go to a local beach to swim, the licensor asked a staff person if she and other staff had access to the program's aquatic plan. The staff person indicated she had not seen the written plan and neither had the other school age staff. When the licensor asked the director if there was an aquatic plan, the director presented an aquatic plan that was written in 2014 and had not been updated nor shared with staff. The director said staff were trained on aquatic safety during staff meetings and through written communication from the child care director and aquatic director. When the licensor asked the director and school age staff person if the program took a copy of the aquatic plan with them on swimming field trips, both the director and staff person said no. The director and school age staff decided not to take the children swimming on the day of the visit and said they would not take any swimming field trips until the aquatic plan was updated and shared with staff. Corrective Action: Immediately update the program's aquatic plan and review the updated plan with all staff who supervise children during swimming activities before any further swimming activities are facilitated. As children participate in swimming activities, staff must take a copy of the aquatic plan with them to all swimming activities. The aquatic plan must be updated yearly. By 9/10/2019, email the program's updated aquatic plan to this licensor along with an improvement plan on how the aquatic plan will be updated annually and shared with all program staff who accompany children to swimming activities.”

“A three-year-old child left his classroom, walked down the hallway, down the stairs and exited the double doors to the parking lot without his teachers noticing his absence. The child was found by another parent in the parking lot. The classroom teachers were not aware the child left the classroom until he was brought back by the director. It was confirmed he was out of his classroom for approximately 5 to 6 minutes. A child being unsupervised and leaving the building without staff knowing he is missing is a serious violation. Corrective Action: Immediately ensure all children are supervised as required in this rule. By 11/2/2018 develop a written plan to ensure supervision of children is maintain at all times. This plan shall include a review of supervision practices and policies with all staff. By 11/7/2018 mail the parent notification letter as outlined above and submit the list of parents, their contact information, and who received the parent notification letter to this Licensor.”
