Regulation 5.10.1.3.4: The licensee shall ensure that any outlets used for drinking, cooking purposes, and brushing teeth is potable by meeting Vermont's legally enforceable drinking water standards at all times. Bottled water for drinking, cooking purposes, and brushing teeth shall be provided until such time as at least one (1) outlet meets Vermont's legally enforceable drinking water standards and is in compliance with CBCCPP rule 5.10.2.1.2.
“Upon review of the Vermont Department of Health's database for lead water testing, it was identified that the last testing at this program was conducted October 1, 2019. Staff statements reflect that this testing was overdue. Corrective Action: Immediately begin using bottled water for drinking, cooking, and teeth brushing. By 03/09/2026 make contact with the Vermont Department of Health to initiate lead water testing. Develop a sytem to ensure that such required testing is conducted in a timely manner, every three (3) years, moving forward. In the corrective action email provide evidence that you have connected with VDH and provide details of the system developed to ensure compliance moving forward.”

Regulation 7.1.2.2: Staff who are counted in the staff/child ratios and auxiliary staff left alone with children and/or counted in staff/child ratio as specified in the rule 6.2.1.8 of these regulations shall obtain training in pediatric first aid and in infant and child CPR within three (3) months of beginning work in the CBCCPP and remain currently certified.
“Staff A and Staff B are without current First Aid certification. Staff C and Staff D are without current CPR and First Aid. Corrective Action: Ensure staff obtain the required training by the identified due date. In the corrective action email, provide copies of their First Aid and CPR certification to confirm completion, and identify the system the program has implemented to ensure both CPR and First Aid is current ongoing and prior to the expiration date.”

Regulation 5.10.1.2.1: The licensee shall ensure that the CBCCPP is in compliance with Vermont Division of Fire Safety rules at all times. This includes but is not limited to: * Complying with Vermont Division of Fire Safety inspection reports; * Having regular fire systems inspected with violations identified during the inspection noted as corrected; and * Having fire extinguishers tagged with valid inspection tags.
“When asked whent the last fire inspection was done, the Director stated that the extinguishers were done recently but was unaware of a fire panel box. The Director was uncertain where the box was but after searching it was located and determined that the last inspection was done August 2020. Corrective Action: Schedule an inspection and provide copy of that report. Develop a system to ensure ongoing compliance to this rule is met.”

Regulation 3.7.2.2: The licensee shall ensure that evacuation drills are conducted at least once a month, and children and staff are evacuated in under three (3) minutes. Licensees of a CBCCPP located within a public or independent school building may count a lock-down drill performed while the CBCCPP is in operation in place of a monthly evacuation drill with the CBCCPP children and staff and at least three (3) of the monthly drills conducted within 365 days shall be evacuation drills.
“Upon request to see evacuation drill logs, the Director advised they did not have previous records available, and confirmed that an evacuation drill had not been conducted for quite some time prior to their start date in October 2021, and that an evacuation drill had not been conducted since then. Corrective Action: Review the evacuation expecations with staff and conduct monthly drills ensuring compliance to this rule is met. Regulation 6.2.1.3: The program director shall ensure that the number of staff present meets requirements described in the chart below for ages of children, maximum group size, and staff/child ratios at any time of day.
“Upon review of attendance records and staff schedules, it was determined that the program was operating out of ratio on April 21 2022, and April 7, 2022. Between 1:00 and 1:30 on April 21, 2022, the one (1) to two (2) year old classroom had five (5) children present to include Child A who was only seventeen months. During that time Staff B was the one (1) staff present; licensing regulations require two (2) staff based on the age of the youngest child in that group. Also, on April 21, 2022 in the two (2) to three (3) year old classroom, between 9:03 and 9:19 Staff C was with seven (7) children. Based on the ages of children in that group, a second teacher is required when there are more than five (5) children present. On April 7, 2022 between 10:00 and 12:44 in the preschool classroom there were eleven (11) children present; licensing regulations require a second staff person once this age group exceeds ten (10); the Director was the only staff person present with this group of children during that time. This is a serious violation. Corrective Action: Ensure ratios are met and maintained, to include determining the age of the youngest child in the group to ensure compliance to this rule. Provide a schedule that reflects the ages of children, and what room they are in to show how the program will maintain compliance. Send a copy of the licensing report by mail or email to the parent(s) of each child enrolled. Provide a list of each parents name, childs name and contact information to this Licensor upon completion of parents being notified.”

“Upon arrival at the program children were observed playing on a dome climber; this structure measured over thirty (30) inches from the ground and did not have any cushioning material underneath it as required by this rule. Corrective Action: Until the required depth of cushioning is in place ensure children do not have access to any structure outdoors measuring over thirty (30) inches from the ground. Develop a system to monitor that any required cushioning is maintained to ensure ongoing compliance to this rule.”
