“The following actions or threats thereof are forbidden: physical punishment, striking a child, roughly handling or shaking a child, restricting movement through binding or tying, forcing a child to assume an uncomfortable position, or exercise as punishment. On April 20, 2026, Staff 1 was seen on video roughly handling Child 1 (age 3). Staff 1 grabbed Child 1 by the ankles, by the arm, and by the shoulders and forced him to sit down on the bathroom floor. Staff 1 hit Child 1 in the head with a plastic basket and pushed the child away from her. Staff 1 hit Child 1 in the face, with a closed fist, causing his head to turn to the side. Staff 2 said Staff 1 was "being aggressive" with Child 1.”

“When time out is used as a behavior guidance technique: It shall be used sparingly and shall not exceed one minute for each year of the child's age. Staff 1 is seen on video with Child 1 (age 3) in time out in the bathroom from approximately 4:51 p.m. to 5:01 p.m.”

“Behavioral guidance shall be constructive in nature, age and stage appropriate, and shall be intended to redirect children to appropriate behavior and resolve conflicts. Staff 1 is heard on video saying to Child 1 (age 3) "I'm going to break you.", "Get off me", "Get it together", and "I'm going to be on the news for this". Staff 2 stated that Staff 1 was harsh in tone.”

“Staff members caring for any child for whom emergency medications have been prescribed must have the appropriate Medication Administration Training. Child A has an emergency seizure nasal spray medication on site, but there are no staff certified in Medication Administration Training -( MAT) Seizure Rescue Nasal Spray Course.”
