Regulation 5.4.2.6: Clothing sacks or similar clothing designed for safe sleep may be used. Bibs, necklaces, and garments with ties or hoods shall be removed from the child prior to placing the child in the crib or port-a-crib.
“An infant was asleep in a crib covered in a small blanket. Safe sleep practices do not allow infants under 12 months of age to sleep with a blanket. Corrective Action: Effective immediately, all infants may only sleep in approved sleep sacks or other similar clothing designed for safe sleep. Submit confirmation of a safe sleep training that infant staff members will complete by 9/18/2026. Submit an email detailing how staff will be supervised to ensure safe sleep practices are being followed at all times.”

Regulation 3.4.1: The licensee shall keep all required records, schedules, materials, and equipment used to operate and maintain the CBCCPP in good order and in locations appropriate for day to day access.
“This licensor asked the Director for the staff schedule for June and July. After several minutes looking in the filing cabinet and the computer they stated they only had access to the schedule they created for the last two weeks which was captured in emails and they would need time to gather them. The Director did not know how to access the schedule prior to those two weeks as they were recently hired. I was told that children's attendance sheets prior to the current week are kept off site. Corrective Action: A program improvement plan shall be created that ensures at any given time a representative from the Division has access to all required records, schedules and documentation including but not limited to an accurate staff schedule and daily attendance sheets. If these documents are kept in electronic format or in the Brightwheel application the Director must ensure that staff can provide access to this information in their absence. Leadership shall ensure that when a new Director is hired, they are aware of where all documents are kept and can access them. Staff schedules and daily attendance information must be saved for one (1) year. By the corrective action due date email a copy of the program improvement plan to [name].”

Regulation 7.5.4: The program director shall establish and implement a system of communication among staff to ensure that any staff member assuming responsibility for a child or group is informed of significant information related to the care and education of the child or children.
“Based on information gathered though staff interviews, staff are frequently moved into new classrooms and are not provided with information about the classroom routine and specific needs of the children in their care. Staff have shared that they were assigned to work with age groups they had little to no training on. A staff member stated they were assigned to work with infants; an age group they had never provided care for and was left in this group with another staff person who also had limited experience in an infant classroom. Another staff member who typically worked with young toddlers was moved to an older age group and was not aware of toileting practices in this group. This staff person asked a three-year-old child to use the toilet, when the child stated they did not need to go, the staff person pulled the child's pants down and sat them on the toilet. This upset the child and they told their parent what happened. The staff person stated that when they work with the younger toddler's toileting consists of changing the diaper/pull up and in some cases placing them on the toilet as part of toilet training. They were not aware they should not have followed that toileting practice with a three-year-old that communicated they did not need to go to the bathroom. It should be noted that the program notified licensing of this incident. Corrective Action: The Director and the teacher associate assigned to each classroom will create a classroom information folder. The folder will contain information about allergies, special care needs, daily routine, and any other special instructions. The folder will be shared with new staff prior to working in a classroom. The Director shall be aware how much experience staff members have with each age group. If a staff person only has experience working with infants for example, they will not be utilized with a different age group until the Director has had time to orient them to a new age group in pre-planned manner. These folders will be reviewed in an upcoming licensing visit.”

Regulation 6.2.8.2: The program director shall create and utilize a positive transition plan with the introduction of a new staff member and shall ensure that parents are notified.
“Based on information gathered through conversations with parents and through staff interviews, when a new staff member is hired the program does not create an adequate transition plan to introduce the new staff member to parents. It is reported that parents often are unsure of which staff are caring for their children or are assigned to their children's group. One parent stated that it was not unusual to see a new adult in their child's classroom at drop off or pick up time and have to figure out on their own whether it was another parent or a staff member. Corrective Action: Every classroom must maintain a staff information space, in a location that is visible to parents. The space must include a photo of the staff member, their name and role in the classroom. When new staff are hired this space will be updated, parents will receive written notification and the new staff member will be introduced to parents. This is not required for substitutes or float staff, however the program shall instruct staff to introduce themselves to parents. All parents shall be easily able to identify the staff responsible for the care of their children.”

Regulation 5.10.1.13.1: The licensee shall ensure that the CBCCPP has an operating telephone that is present and in service at all times children are present. The telephone number shall be provided to the Division and the parents of children that are enrolled. If an answering machine is used, staff shall check it every fifteen (15) minutes to ensure parents are able to communicate with staff during the day.
“This licensor arrived at the program and activated the video intercom. After several tries I called the program contact number listed in the Bright Systems Information System. My call went to [name] voicemail, she is not regularly present at this program. Eventually, I called my supervisor and requested phone numbers for members of the leadership team. I was able reach [name] who stated she would text the Director and let them know I was at the door. I later learned that parents are asked to communicate with the program using the Brightwheel app, parents are not provided with a direct phone line to the CBCCP. Brightwheel may be used for communication with families but it does not negate the requirement to have an operating telephone that parents or the Division can use to contact someone on site. Corrective Action: The program must provide parents and the Division with a phone number that is connected to this site prior to reopening. By the corrective action due date update the contact number in BFIS, if you have issues making this update please provide Licensor [name] with the phone number.”

Regulation 5.11.6.5: Bottles shall be individually labeled with the infant's name and refrigerated immediately after preparation by staff or upon arrival if prepared by a parent.
“While present with the Director, this Licensor overheard walkie-talkie communication with an infant staff member. The staff person stated they were putting an infant down for nap and wondered if they needed their bottle first, based on the bottle log it did not appear the infant had a morning bottle. The Director advised that the infant should have a bottle before nap. The staff person responded that all bottles were not labelled and they were unsure which bottle belonged to the infant. Information gathered during staff interviews indicates that bottles are not consistently labelled. Corrective Action: Moving forward ensure all bottles are clearly labelled. Ensure the label is on the bottle and not on the cap.”

Regulation 4.4.2: Staff shall encourage and facilitate two-way communication between the CBCCPP and parents. Staff shall communicate regularly to parents about CBCCPP activities and program policies, community resources, and shall allow many opportunities for parents to provide information, identify preferences, ask questions, and share concerns.
“Based on information gathered from staff and parents, parents repeatedly requested a meeting with leadership and the director to discuss concerns and ask questions. This request was not met in a timely manner and after parents continued to make the request leadership offered an online meeting on 07/30/2026, which leadership abruptly cancelled the meeting the day of. Parents report that it is difficult to get responses to their questions, they feel unheard when they receive a response, communication is often not clear or what they are told quickly changes and there is a disconnect between what leadership tells parents and what they tell staff. Corrective Action: On 08/24/2026 this licensor met with the current Director Jahelle Armstrong and [name]. They stated that they plan to contact parents and set up the opportunity to meet with them. By the corrective action date please confirm with Licensor [name] the date that the meeting(s) will occur. Moving forward ensure that when parents request a meeting, one is scheduled in a timely manner.”

Regulation 6.2.5.2: Staff shall appropriately hold, touch, smile and talk to children.
“Staff X forcibly attempted to place a T-shirt used as an art smock on Child A. Children were not required to put a T-shirt on as it was optional. During the interaction, Child A was pushed to the ground as Staff X attempted to put the T-shirt over their head. Child A began to cry, got up and ran away from Staff X. The other staff member present reported they had to comfort the child before they would return to the art activity. The Director learned about the incident on 06/14/2026 when Child A's parents contacted them because a staff member had emailed them information about the incident involving Staff X. The Director then contacted the staff person who witnessed the incident who did report the incident to another staff person but had not yet told the Director. This is a serious violation. Corrective Action: Please speak with all staff and ensure that they understand they must notifiy the Director or a member of the leadership team in a timely manner when they observe a concerning interaction between a staff member and a child. A Parental Notification Letter (PNL), which is a copy of the licensing report, must be provided to each parent of every child enrolled within ten (10) days of the report submission. Before the corrective action due date provide Licensor [name] Fitts-Pratt with a list of parents names, child's names and contact information for each child that is enrolled.”

Regulation 5.1.1: The licensee shall ensure that the CBCCPP environment and practices support children's health and safety.
“Staff reported to the director that Staff X placed a blanket on an infant in a crib more than once, continuing even after being instructed not to do so. The director did not speak directly with Staff X about the incident and thus could not evaluate if Staff X required further training on safe sleep practices. Instead of addressing the situation the director removed Staff X from the infant room schedule. Staff X continued to work in other classrooms, where staff reported concerns with Staff X's ability to maintain compliance with health and safety requirements while working with children. These incidents included using their cell phone while working with children, using one child's bug repellent patches on all children in the classroom and not following instructions related to classroom routines provided by the lead staff in the classrooms they provided care in. Written documentation about the incidents involving Staff X were created after they were terminated. It was reported that prior to these incidents the program did not have a formal way to document when staff acted in a manner that violated licensing requirements. Corrective Action: The Director shall document concerns with staff in a consistent manner that tracks when the concerns were identified, details regarding the concern and follow up conducted with any applicable staff to which the concern applies. The Director shall additionally document check-ins, and assess whatever additional training or specific mentoring is required based on the concern and account for those in the staff's file as being provided.”

Regulation 3.2.5: Self-reported violations: If an incident or situation occurs in a CBCCPP while children are present that could be considered a serious violation as defined in the rule 2.2.50 of these regulations, the licensee has a responsibility to self-report this to the Division within twenty-four (24) hours of the incident. A complete report will include a description of the incident, what the licensee has done to verify the particulars of what occurred, and how the licensee has taken corrective action to ensure the safety and well-being of children and to prevent a future serious violation. If such a report is received in a timely manner from a licensee with a history of consistent regulatory compliance, no child has been seriously injured or harmed as a result of the incident or situation, and the licensee has taken prompt and appropriate corrective action; the Division may, on a case by case basis and at the Division's discretion, elect to issue a warning, rather than a violation related to that incident or situation.
“Staff X roughly handled Child A which is a violation of regulation 6.2.5.4. Post termination, the documentation to account for this incident indicated this event had been reported to the Child Development Division, however this did not occur as required. Corrective Action: Submit a program improvement plan that 1) confirms your understanding of the notification to child care licensing requirements, and how to enter a self-report through the Bright Futures Information System (BFIS), 2) identifies the person on the leadership teams that will ensure the current Director and any future Directors will have this reviewed with them upon hire and 3) identifies who is responsible for the actual notification made to the Division.”

Regulation 3.7.2.2: The licensee shall ensure that evacuation drills are conducted at least once a month, and children and staff are evacuated in under three (3) minutes. Licensees of a CBCCPP located within a public or independent school building may count a lock-down drill performed while the CBCCPP is in operation in place of a monthly evacuation drill with the CBCCPP children and staff and at least three (3) of the monthly drills conducted within 365 days shall be evacuation drills.
“A review of the evacuation drill log reflected that drills were not practiced in the months of February or April of 2026. Corrective Action: The program must practice two (2) evacuation drills in June and in July so that children and staff become familiar with the practice. In August return to completing one (1) evacuation drill a month. Submit confirmation of completed drills and ensure that drills will be practiced monthly.”

Regulation 7.3.1.3: The program director of a CBCCPP licensed to serve thirteen (13) - fifty-nine (59) children shall be qualified as a teacher associate, and shall have completed either: * A Vermont Early Childhood and Afterschool Program Director Step One (1) Certificate; or * Successful completion of a three (3) college credit course in program management for early care and education or for school age care and education, or in staff supervision related to early care and education of children; and a three (3) college credit course in curriculum.
“It was discussed that the approved program director left in February 2026. A director change notification was not submitted. It was discussed that the individual acting as the interim director does not meet qualifications. A variance request was not received asking for approval of a director. Corrective Action: Submit a plan on who the director will be and how they will meet qualifications. Include in the plan how leadership will work at the program and how staff will be supervised by the director to ensure compliance with the licensing requirements.”
