“Staff at the program did not have complete and up to date BFIS accounts and there were no staff files on site at Berlin Elementary School. This licensor drove to the U32 district office, and found that these documents were also not available at that location. Regulation 5.10.1.1: General Safety: The licensee shall ensure the physical facilities of the CBCCPP, grounds, equipment, and toys present no hazard to the health, safety, and well-being of the children.
“Child A tripped and fell into a hole that older children dug on the school aged playground. Child A sustained broken bones in his arm, required surgery where pins were needed. The hole was approximately 3 feet by 4 feet wide and 2.5 feet deep. The hole was filled in with cement pieces and sand the day of the visit, I determined an approximate depth from the Head Custodian paired with my inspection of the hole. This size of this hole is considered a hazard. The hole was located on the edge of a sandy volleyball court that is now used by Pre-K children as a giant sandbox. There was nothing surrounding the edges of the hole and it would be hard for a child to see the hole while running through the playground. The ground surrounding the hole was frozen at the time of the injury. Based on interviews with the witness, they observed that most of Child A's body was in the hole after Child A tripped. Additionally through interviews it was discovered that children are allowed to use equipment not designed for children ages 3-5 years old. Furthermore children were using the equipment on a day where the cushioning material was frozen and would not provide required cushioning if a child fell. Although use of equipment not designed for Child A's age did not cause the injury, it speaks to non compliance with this regulation and increased the chances of injury during outdoor play. During this visit I notified the Director and staff who were present that the practice of allowing the children to use the equipment disussed in this report would immediately stop. Corrective Action: Although the hole has been filled, the program will need to continue to monitor the area where the hole is located. Due to winter conditions there could be a shift in the materials used to fill it in. The program put up cones and tape to block access to this area and that should remain up until the hole is completely filled in and flush with the surrounding ground. Staff will be required to review the US Consumer Playground Safety Handbook(https://www.cpsc.gov/safety-education/safety-guides/playgrounds/public-playground-safety-handbook) Once staff have reviewed the handbook the program will email this licensor a document stating that staff have reviewed the handbook. The staff will be required to sign this document.”

Regulation 2.3.9.3: The licensee shall ensure that all staff have met ongoing background check requirements by submitting at least once every five (5) years a Records Check Authorization form to the Division and as required shall submit to fingerprinting.
“Staff A,B and C did not complete a renewal of their fingerprint supported background clearance by the 5 year renewal date. Staff A and B were last fingerprinted in March of 2018. Staff C was last fingerprinted in August of 2018. Corrective Action: Immediately send new record check authorization forms for Staff A,B and C. Staff will need to set up fingerprint appointments as soon as possible. Email this licensor once all three staff have completed fingerprinting. Email this licensor and describe how the program will track when staff are due to renew their fingerprint supported background checks.”

“Inspection of the playground revealed that mulch is breaking down and grass is now growing where mulch should be. There are cushining mats directly under the swings but in areas in front of and behind the swings grass is now growing. There was grass seen near the swing posts. Corrective Action: Children may not use the swings until the grass has been removed and mulch depth is reassessed after the grass is removed. Please add mulch as needed to areas where grass was growing. Send this licensor a photo of the swingset area once the corrections are made. Ensure moving forward regular maintenance occurs to ensure that grass is not overtaking the mulch.”

“Staff person A has not yet submitted to the CDD fingerprinting supported background check process. A Fingerprint Authorization Certificates along with instructions was issues on 7/17/2018.
