    • Records and paperwork

Regulation 3.4.6.5: Staffing Schedule: A licensee shall maintain a written record of the daily schedule for at least 365 days of all staff including exact days and hours worked and the group of children to whom they are assigned.

“A review of the staff schedule for the month of May and the first week of June 2026 did not clearly indicate all staff hours worked, breaks, lunches, and the group of children assigned to them throughout the day. The program director did not have the required information, making it impossible to confirm staff/child ratio. Corrective Action: By 10/05/26, submit to licensor supervisor bridget.humphries@vermont.gov the system you will use to document the staff schedules. The system should include how you will indicate staff hours of work, breaks, lunch break and time away from the site during working hours and how you will keep the information accurate.and up to date. Status: Appeal Period.”

    • Background checks

Regulation 7.2.2: The licensee shall ensure that all new staff and auxiliary staff, prior to working with children in the CBCCPP; and any new individual designated as the representative of the licensee shall submit a Records Check Authorization form to the Division and shall submit to fingerprinting at a location designated by the Division after having received the Fingerprinting Authorization Certificate by the Division.

“One (1) substitute had not followed through with all pieces of their background clearance prior to this licensing visit. Staff A received the form to complete fingerprinting and the out of state record check form on 12/3/2025. On the same day the state of Florida returned the out of state form they received via email to the program and to the Division identifying the requesting agency needed to sign the form, not the Director. The following day the Child Development Division forwarded the same email chain to the program identifying "Your Florida background check form has been rejected (see below). These are supposed to be sent to our office for my signature. Please resend to me and I will sign and submit. Thank you." The program did not return the corrected form to the Division. In addition, Staff A was unable to provide a receipt or indicate the location and date fingerprints were taken to confirm compliance with that portion of the background check. Post visit, the program did send a fingerprint receipt showing that the substitute had been fingerprinted on 2/19/2026, the day after the licensing visit. Corrective Action: Since the licensing visit, the Division has resent the out of state form to the program and received it back for further processing, and the program has confirmed with the Division that fingerprints have been obtained. Ensure Staff A is not left alone with children until the program receives notification that their background clearance has cleared. Submit a statement to the Division of the system the program will create to follow up on submissions of record checks and out of state forms, as well as maintaining documentation of completed fingerprints moving forward.”

Regulation 7.2.4: The licensee shall ensure that no person shall be left alone with children without approval from the Division which shall be based on the results of the background check to include fingerprinting.

“Two staff have been left alone with children and results of their fingerprints have not been received. Staff A was hired in September 2020 and was alone with children during the licensing visit. Staff B was hired in March 2021 and during the licensing visit she stated she has been left alone with children. Corrective Action: Effective immediately do not leave staff alone with children until they have successfully passed a background record check. By 5/10/21, submit a statement to terri.layton@vermont.gov with your understanding of background record check requirements and how the program intends to ensure that staff are not left alone with children until approval is received from the Division.”
