“A violation was cited to this rule on 6/30/2026 and corrective action was due by 8/5/2026. On 9/22/2026 an email was sent to Kimberly to obtain the CPR and First Aid certificate by 9/23/26 at 1:30. Regulation 5.10.3.3: Safe Use Zones For all play equipment that is thirty (30) inches or higher from the ground, including climbing equipment, slides, swings and other similar equipment, the FCCP shall ensure that the surface under and around the equipment, included recommended use zones, is of approved resilient material that protects children if they fall. * Materials in the use zone shall consist of wood chips, pea stone, mulch, engineered wood fibers, sand, safety-tested shredded or rubber like material or rubber mats designed for protective cushioning; * Materials used in the use zone shall follow the recommendations listed in the most recent publication of U.S. Consumer Product Safety Commission's Public Playground Safety Handbook regarding critical depth of tested materials determined by the height of the highest climbing surface of the equipment; * Materials used in the use zone shall be installed and maintained according to the manufacturer's instructions; * If the loose material such as sand, mulch, or shredded rubber is used in use zones, the FCCP shall ensure that the material is raked regularly and replenished to maintain depth and resilience; and * If the resilient material in use zones freezes, the FCCP shall ensure that the children will not play on the equipment until the resilient material has thawed and is once again resilient.

“A violation was cited to this rule on 6/30/26 and corrective action was due on 8/5/2026. An email was sent to Kimberly on 9/22/26 requesting corrective action by 9/23/26 at 1:30. Kimberly acknowledged the email and provided a picture of the playground stating the swings were removed. However, the picture showed the swings in place and a mat beneath them which does not extend the area required as outlined in the National Playground Safety Handbook referenced in the original violation. Corrective Action: Ensure children refrain from the swings until proper cushioning material is in place. Provide Supervisor Humphries with photo documentation that 1) swings are removed, or 2) cushioning material meeting the depth and width required are in place. Status: Appeal Period.”

Corrective Action: Make the swings inaccessible to children until enough cushioning is installed for the type of material and the height of the equipment as recommended by the U.S. Consumer Product Safety Commission Public Playground Safety Handbook. Email Licensing Supervisor [name] a photo showing that the swings are either removed, off limits, otherwise inaccessible to children, or showing sufficient cushioning material and a statement that the children will not use the swings unless sufficient cushioning is installed.”

Regulation 7.4.4: All staff, with the exception of substitutes, shall complete fifteen (15) clock hours of annual professional development activities as required in the rule 7.4.2 of these regulations.

“It was found that the provider completed eight (8) of the required fifteen (15) hours of annual professional development for the period of 9/25/2023 to 9/24/2024. The provider said that she believed she was in compliance based on information received during the last compliance visit, and as a result, did not complete the remaining seven (7) hours. Corrective Action: The provider submitted certificates for seven (7) hours of professional development completed on 6/29/2025 which fulfills the seven (7) hour deficit for the period of 9/25/2023 to 9/24/2024. By 7/24/2025, please send these certificates to Northern Lights at CCV for upload to BFIS. Additionally, by 7/24/2025, email Licensor [name] to confirm that fifteen (15) hours of professional development will be completed by 9/24/2025 to meet the requirement for the current year, covering the period of 9/25/2024 to 9/24/2025.”

Regulation 6.2.1.5: The registered FCCP shall ensure that the number of staff present meets requirements described in the chart below for ages of children, maximum group size, and staff/child ratios at any time of day.

“The provider acknowledged that three (3) children under the age of two were present at the program at the same time, and that additional children were also present on some of those days. The rule states that a provider may only have two (2) children under the age of two (2) unless there is an assistant working with the provider or there are no other children present at the same time. This is a serious violation. Corrective Action: The provider agreed to submit a variance request to ask for permission to provide care for the three currently enrolled children under the age of two (2) years. This variance request must be completed in BFIS by 10/4/2023. In addition, the provider must send this report to all parents of enrolled children and email a list of all parents of enrolled children along with their contact phone numbers to Licensor [name] at robin.rielly@vermont.gov by 10/4/2023. The copies of this report may be emailed, mailed, or physically handed to the parents of enrolled children.”
