Regulation 5.10.1.1: General Safety: The licensee shall ensure the physical facilities of the CBCCPP, grounds, equipment, and toys present no hazard to the health, safety, and well-being of the children.
“The licensing site visit report from 05/01/2025 cited a violation for this regulation and provided required corrective action.During the 04/04/2025 it was noted that a cylinder shaped fish tank that contained water and fake fish could present a tipping hazard because only the bottom was secured to the wall with a metal strap. This licensor was able to wiggle the tank back and forth. On 04/15/2025 the director sent an email stating that they had ordered a strap to secure the top of the tank and would install it the next day. When this licensor returned to the program on 05/19/2025, over a month after the director sent the email, the tank remained secured only at the bottom and the top strap was not present. On 05/19/2025 I notified the director that I would cite this violation again and the tank needed to be secured or removed immediately. The director stated they did order the strap but was having troubles installing it, as it was not the right fit. When this licensor returned on 05/28/2025 the fish tank was no longer present. This is being cited again as the tank remained in place a month after the director was instructed to secure it. The prior report identified this tank as made of glass, this was an error the tank is made of plastic. The violation was not cited because of the material it was made of, it was cited because the height of the unit is taller than some of the children in care, it was not properly secured and could create a tipping hazard and when moved around created space where a child's hand or foot get pinched. A video was taken that captures the instability of the unit when it was pushed on. Corrective Action: Corrective action requirements have been met. Moving forward ensure that when licensing identifies a hazard and requires action, the program follow through with the corrective action by the due date.”

Regulation 5.4.3.2: Children shall not be required to sleep. Children who do not nap shall be provided space and equipment for quiet play.
“During a licensing visit on 04/10/25, regarding a concern reported to the Child Development Division, this licensor observed staff requiring children to remain on their nap mats for thirty-five minutes and non nappers were not provided with quiet activities. The director was notifed that this practice was in violation of this regulation. The site visit report issued on 05/01/2025, notified the program that a violation would have been cited if these observations were made during a yearly regulatory visit, and that violation would not be cited because this incident did not directly related to the concern that was being investigated during thst visit. During a visit to the program on 05/19/2025 to investigate a new concern recieved by the Child Develpment Division the following was observed. Children finished lunch and were directed to use the bathroom and then go to their nap mats. At 12:30 all nine (9) Pre-K children were in the classroom with Staff A and the director. Of the nine(9) children I observed two(2) settle down onto their nap mats. The remaining seven(7) children were either moving around on their mat or were up and moving around the room. The director and Staff A followed the children around the room and repeatedly told them to get onto their nap mats. Children continued to walk around the room, interact with each other, and ignore requests to remain on their nap mat. A child appeared to be upset and was yelling at staff stating they did not want to get on their nap mat, eventually that child opened the door and left the room. The director followed the child into the hallway and directed them back into the room. After thirty(30) minutes Staff A handed out boxes containing manipulatives for quiet play, however the expectation to remain on their cot continued. During this time I observed the director say to Staff A that this is impossible. After several minutes the director put the lights on and said naptime was over. Later the director told me that most of the children nap each day and perhaps my vist is causing the children not to sleep. I asked if she knew how many of the four(4) and five(5) year olds were still napping at home. She stated that parents report they all nap at home. I shared with the director that I spoke with a parent as part of the previous concern in April and learned that their child does not nap at home, the director stated recently the family started having the child nap at home again so that they would nap while at the program. Since that visit the program sends the Pre-K children that nap to the toddler room and the non nappers remain in the Pre-K. This can only happen when they have enough staff to meet ratio requirements. During the visit on 05/28/2025, this practice was observed. Licensor [name] was present in the Pre-K classroom and reported that Staff A attempted to have the children settle on their nap mats so she could read to them. She started to read the book but the children were not paying attention to her. After about three(3) minutes Staff A stopped reading, turned on the lights and allowed children to engage in free play. Corrective Action: The program is required to engage with a Quality Support Specialist from the SPARQS program, provide overdue corrective action, attend progress meetings between the Quality Support Specialist and Licensor [name], and is found in compliance with this regulation during a follow up licensing visit. The director agreed not enroll any new children until are corrective actions requirements are met.”

Regulation 6.2.6.5: Children shall be protected from the harmful acts of other children.
“On 05/01/2025 a violation was cited for non compliance with this regulation and the following corrective action was required by 05/12/2025. Create a program improvement plan that includes the following. How staff will intervene when they observe a child or children engaged in behaviors that could cause injury or bodily harm to themselves or another child. Please review the observations captured in this violation and have a conversation with staff about the potential injuries that could have resulted. The plan should also address how staff will communicate with each other if they have a safety concern about a child or children that are not in their classroom. This licensor did not receive a copy of that plan,a verbal reminder of the overdue corrective action was provided to the director on 05/19/2025. Additionally, during a follow up licensing visit on 05/28/2025, five(5) Pre-K children were observed hitting each other with stuffed animals while sitting in a cozy area set up for use by the toddlers during transitions. Staff A walked over and directed them to stop hitting each other several times, when they continued hitting each other, Staff A stopped the verbal redirection and walked away. The children continued to hit each with stuffed animals for two(2) to three(3) more minutes. Later in the Pre-K room a toddler was hitting and kicking a Pre-K child, staff did not appear to notice and did not stop the child from hitting and kicking the other child. Corrective Action: The program is required to engage with a Quality Support Specialist from the SPARQS program, provide overdue corrective action, attend progress meetings between the Quality Support Specialist and Licensor [name], and is in compliance with this regulation during a follow up licensing visit. The director agreed not to enroll any new children until all corrective actions requirements are met.”

Regulation 6.2.7.4.4: No form of inappropriate discipline or corporal punishment shall be used with children such as but not limited to: Confining a child in an enclosed or darkened area, such as a closet or a locked room;
“On 05/01/2025 a violation was cited for non compliance with this regulation and the following corrective action was required.Please review this regulation with all staff to ensure ongoing compliance with this regulation is met. Email this licensor by the corrective action due date and confirm that this regulation was reviewed with staff. Corrective action has not been received. On 05/19/2025 the director was provided with a verbal reminder that corrective action was overdue. Corrective Action: The program is required to engage with a Quality Support Specialist from the SPARQS program, provide overdue corrective action, attend progress meetings between the Quality Support Specialist and Licensor [name], and is found in compliance with this regulation during a follow up licensing visit. The director has agreed not to enroll any new children until all corrective actions requirements are met.”

Regulation 6.2.6.1: Staff shall be able to hear all children of pre-kindergarten age and younger at all times, shall be able to see the children with a quick glance, and shall be able to physically respond immediately.
“During the licensing visit on 04/10/2025, supervision concerns in the common area were discussed with the director and the concerns were captured on the site visit report issued on 05/01/2025. The program was required to spilt up the Pre-k group of children when transitioning to the playground from the common room. The program did make this change however the following observations indicate that the placement of the cubbies continued to create supervison challeges for staff. On 05/19/2025 one staff member was observed sitting at the lunch table in the common area with five(5) toddlers. One of the toddlers left the table and walked around the cubbies and entered the area where Pre-K was eating. The toddler staff member had to call over to the Pre-K staff for assistance because she could not leave the toddlers she was supervising to retrieve the child. Later several Pre-K children were observed running away from Pre-K staff and entering the toddler side of the cubbies. One staff member was at the bathroom assisting children and the remaining staff member had to stand at the end of the cubbies and yell at the children to come back, as they could not leave the Pre-K children eating at the table. During the visit this licensor told the director that the cubbies would need to be removed as they were creating a blind spot that created non compliance with this regulation. The cubbies were removed from the center of the common area on 05/23/2025, however the following observations indicate that even with the cubbies removed supervision concerns remain. During the 05/28/2025 visit, Licensor [name] observed that Child X left the classroom with Staff A to get something from their cubby. Meanwhile this licensor was in the common area outside of the Pre-K classroom. I observed Staff A open the door and Child X walked to their cubby, located to the left of the Pre-K door. Staff A became engaged in a conversation about naptime with the director who was standing in the entrance way of the toddler room. Staff A and the director ended the conversation, the director returned to the toddler room and Staff A went back into the Pre-K classroom and closed the door leaving Child X alone in the common area. I heard Child X say hey, as they watched the classroom door close. Child X left their cubby and let themself back into the classroom. It appears that Staff A forgot that Child X was in the common area when they closed the classroom door. During lunch time the director was helping children in the bathroom and Staff A was at the lunch table and Staff B was transitioning toddlers into the classroom. Staff A,B and the director did not notice a toddler that was climbing up onto the large four child stoller used to transport infants. At one point the toddler had climbed up far enough where most of their body was in the stroller. The toddler eventually got off of the stroller and returned to the group. Later, Licensor [name], observed a Pre-K child kneeling on a table and climbing up on the aquarium containing turtles, staff did not appear to notice this and did not intervene, the child eventually moved away from the aquarium. Although staff were in the same space they were not actively supervising the children and physically responding when children were engaged in behaviors that could cause injury.

Regulation 6.2.7.5: No punitive action shall be taken with children for not going to sleep, for toileting accidents, for failure to eat all or part of a meal or for failure to complete a prescribed activity.
“Licensor [name] observed a child crying at the lunch table, their lunch box was not on the table. Staff A told the child that their sandwich(which was refered to as a meat pattie) was thrown out because the child did not put it back in their lunch box after snack. Staff A continued to tell the crying child that they are asked everyday to put their food in their lunch box and instead put it back in their cubby, the food got warm and it had to be thrown out. The child continued to cry and I did not see Staff A attempt to provide the child with any other food options. I intervened and asked the director if there was extra food that could be provided to the child as their lunch was thrown out. The director stated that the child had a lunch box full of food but is refusing to eat it and only wants his meat pattie. I asked the director to provide the child with their lunch box. Staff A retrieved the lunch box and gave it to the child. The child opened the lunch box took out a pouch and started eating it. He then requested his mac and cheese. Staff A brought the mac and cheese to the microwave but appears to have forgotten it as about ten(10) minutes later was heard telling the director that the child's food was still in the microwave. The director did not respond and about one(1) minute later Staff A was heard saying, I guess I will go get it. By the time the child was provided with their mac and cheese many of the children were already finishing lunch and transitioning back to the classroom. Licensor [name] reported that she observed Staff A tell a child that if they did not sit on their butt they would pack up their food. Other children were told not to talk and that if they did not eat their food would be packed up or thrown out. Staff were not seen using positive guidance to encourage children to eat, a child did become upset because their food was cleared by staff before they were done eating. Observations during the visit indicate that punitive and threats of punitive action were taken for failure to complete a prescribed activity. (1) children would have their food taken away if they did not sit in their chair. (2) the child did not listen and put their food back in their lunch box which resulted it in being thrown away and attempts were not made to provide other food options.

Regulation 5.10.1.1: General Safety: The licensee shall ensure the physical facilities of the CBCCPP, grounds, equipment, and toys present no hazard to the health, safety, and well-being of the children.
“Staff X blocked Child A and Child B from leaving a bathroom by holding the door shut while they were in there without an adult. In that space multiple hazards were identified. There is an approximetely four(4) foot tall glass cylinder that holds water and plastic fish. The bottom of the unit is secured to the wall with a metal strap. The top is not secured to the wall and I was able to wiggle the cylinder back and forth. This unit has a power cord that is plugged in to an outlet several feet away. The cord goes along the wall and then up to the outlet. The section of the cord that goes directly up to the outlet is not secured. The cord hangs loose and could allow a child to pull it from the outlet. There is a wooden divider between the two toilets, it was loose because a screw is missing from the bottom bracket that secures it to the wall. The mirror that the soap dispenser is attached to is missing screws. When you dispense soap the bottom of the mirror moves. Additionally, I was able to pull the bottom of the mirror away from the wall because of the missing screws. Corrective Action: Since the visit the program has addressed the concerns captured in this violation. Please ensure ongoing compliance with this regulation.”

Regulation 6.2.6.5: Children shall be protected from the harmful acts of other children.
“On March 28th 2025, Staff X used their body to block the bathroom door so that Child A and B could not leave the room. Based on staff accounts during this time the children were being silly. One staff member described them as wrestling and being silly another staff member stated she noticed Child A push Child B over. Staff X did not enter the bathroom and intervene. One of the staff members who witnessed the incident, came into the hallway near the bathroom because they could hear Child A and B banging on the walls in the bathroom. During the visit on 04/04/2025 this licensor and [name] from the Agency of Education, observed Child A on the floor using his hands to push another child's head down towards the floor. [name] observed Staff X look over at Child A but did not go over and intervene. I observed a toddler teacher standing two(2) to three(3) feet away from Child A washing a table. I observed that staff member look at what Child A was doing and did not intervene.Staff Y did intervene when they observed what Child A was doing. It did not appear that the child was injured, they were not crying and stood up and joined the group as they headed outside. On 04/10/2025 this licensor and [name] observed children playing in a small space between the doors that lead to the playground. Children were opening and then slamming the door shut. The door is a heavy glass door. At one point a young toddler walked over and almost had their fingers shut in the door. Three staff members were in the common area in view of the doorway and did not intervene. Corrective Action: Please review this regulation with all staff and create a program improvement plan that addresses how staff will intervene when they observe a child or children engaged in behaviors that could cause injury or bodily harm to themselves or another child. Please review the observations captured in this violation and have a conversation with staff about the potential injuries that could have resulted. The plan should also address how staff will communicate with each other if they have a safety concern about a child or children that are not in their classroom.”
