“A center may temporarily reassign a child from his regular group and staff members for reasons of administrative necessity but not casually or repeatedly disrupt a child's schedule and attachment to his staff members and group. On, September 2, 2026, Child #1 (age 4 years) was moved from classroom #1 (4-5 year old's) to classroom #2 (3-4 year old's) when child #2 (age 4 years) arrived to classroom #1, this transition occurred to maintain a 10:1 ratio in classroom #1. At the time of this transition there were three staff available in the building. There are 12 children enrolled in classroom #1 and only one designated staff member to the class. An interview with staff #1 demonstrated that children have been shifted to classroom #2 from their primary care group at varying times in response to teacher's schedules and how many children are present rather than the needs of the children or a set schedule.”

The center has a policy that states ?one week’s notice will be provided for disenrollment, unless the inappropriate behavior jeopardizes the health and safety of other children or members of the Academy’s staff.? 2. On August 31, 2023, the center informed the family of Child #1 (age: 3 years) via email, that ?August 31st will be the final day of enrollment,? for Child #1 and their three siblings. The center has a behavior management policy that states, ?our goal is to limit exclusionary measures and will only be considered when the health and safety of the child, other children, or staff is jeopardized.? “Based on review, a child under 10 years of age was not always within actual sight and sound supervision of staff. Evidence - 1. On the date of inspection (04/22/2022), it was determined that on 04/21/2022, Child #1 (4 years of age) was left out on the preschool playground for approximately 19 minutes. 2. The amount of time was determined by a time stamp placed on a video recording of this incident. 3. This incident was directly linked to the failure of Staff #1 and Staff #2 to do a name-to-face for all children directly in their care. 4. After 19 minutes, Child #1 was located on playground by Staff #1 and brought back to room. No other staff or classroom children were outside at that time.”
