Regulation 5.10.3.3: Safe Use Zones For all play equipment that is thirty (30) inches or higher from the ground, including climbing equipment, slides, swings and other similar equipment, the licensee shall ensure that the surface under and around the equipment, including recommended use zones, is of approved resilient material that protects children if they fall. * Materials in the use zone shall consist of wood chips, pea stone, mulch, engineered wood fibers, sand, safety-tested shredded or rubber like material or rubber mats designed for protective cushioning; * Materials used in the use zone shall follow the recommendations listed in the most recent publication of U.S. Consumer Product Safety Commission's Public Playground Safety Handbook regarding critical depth of tested materials determined by the height of the highest climbing surface of the equipment; * Materials used in the use zone shall be installed and maintained according to the manufacturer's instructions; * If the loose material such as sand, mulch, or shredded rubber is used in use zones, the licensee shall ensure that the material is raked regularly and replenished to maintain depth and resilience; and * If the resilient material in use zones freezes, staff shall ensure that children will not play on the equipment until the resilient material has thawed and is once again resilient.
“Bare ground was observed and minimal cushioning in other areas where cushioning material is required, to include a dome structure used for gardening that could be used as a climbing structure. Corrective Action: As discussed discontinue use of structures measuring over thirty (30) inches off the ground until cushioning material is replenished that meets the depth requirement for the material used.”

Regulation 6.2.1.3: The program director shall ensure that the number of staff present meets requirements described in the chart below for ages of children, maximum group size, and staff/child ratios at any time of day.
“During the visit all ten children that were present were brought into the same room for free play and diaper changing. The youngest child present was 7 months old meaning that the maximum group size is 8. Discussion with the Director indicates this does sometimes happen and they have been working on making sure group size is in compliance. It should be noted that during the first part of the visit the group sizes were in compliance, however group size compliance must always be met. We discussed that during lunch and nap time the groups can combine as long as staff child ratios are met. Once children are finished with lunch or wake from naps group size requirements must again be met. Corrective Action: This is a serious violation and a program improvement plan must be submitted. This plan will identify the children that will be in group 1 and the children who will be in group 2 and will identify staff in each group. Additionally a copy of this site visit must be provided to all of the families with children enrolled at the program. As discussed after the visit you may email the report to the families and include this licensor on the email. I must be able to see the email contact information for each family and have a way to contact them if need be.”

Regulation 5.2.1.1: CBCCPP staff shall ensure that adults and children wash their hands: * Upon arrival at the CBCCPP; * Before they eat, prepare or handle food; * Before and after handling raw meat; * Before feeding children; * After toileting or diapering; * After cleaning; * After taking out the garbage; * After handling animals; and * After outdoor play.
“When the group of 7 children came in from outside only 2 washed their hands before playing in the classroom. Even though they were wearing mittens or gloves hands still must be washed when they come inside. During diapering a staff member was observed using hand santizer in between changing children and used baby wipes to clean the children's hands. Regulations only allow for use of hand santizer when warm running water and soap is not available. Corrective Action: Immediately ensure that handwashing is occuring at all of the times listed within this regulation. Please review this regulation with staff and send this licensor and email stating that staff understand the times when adults and children must wash their hands.”
