    • Building, equipment and play areas

Regulation 5.10.3.3: Safe Use Zones For all play equipment that is thirty (30) inches or higher from the ground, including climbing equipment, slides, swings and other similar equipment, the licensee shall ensure that the surface under and around the equipment, including recommended use zones, is of approved resilient material that protects children if they fall. * Materials in the use zone shall consist of wood chips, pea stone, mulch, engineered wood fibers, sand, safety-tested shredded or rubber like material or rubber mats designed for protective cushioning; * Materials used in the use zone shall follow the recommendations listed in the most recent publication of U.S. Consumer Product Safety Commission's Public Playground Safety Handbook regarding critical depth of tested materials determined by the height of the highest climbing surface of the equipment; * Materials used in the use zone shall be installed and maintained according to the manufacturer's instructions; * If the loose material such as sand, mulch, or shredded rubber is used in use zones, the licensee shall ensure that the material is raked regularly and replenished to maintain depth and resilience; and * If the resilient material in use zones freezes, staff shall ensure that children will not play on the equipment until the resilient material has thawed and is once again resilient.

“The playground utilized by the children of the program contains large equipment which allows for children to reach a height of 30 inches or higher. Staff B stated that children are allowed to utilize the large equipment at all times inlcuding the winter, unless the equipment itself is icy or slippery. This does not meet the requirement for staff to ensure that children not play on equipment that allows them to reach a height of 30 inches or higher when the cushioing materials are frozen and no longer resilient. Corrective Action: Immediately plan to make equipment which allows children to reach a height of 30 inches or higher inaccessible to children or to ensure children not utilize this equipment until such a time when the cushioning material has thawed and is once again resilient. Develop a system which will prompt you and/or staff to regularly monitor the cushioing materials under and around playground equipment for proper depth, placement and resiliency. Include in the system the details of whom will be responsible for monitoring the cushioning material, how often the checks will occur, how decisions will be made as to the use of the equipment based on these checks, whom the staff shall report cushioning maintenance needs to, and whom will be responsible for maintaining and replenishing the cushioning materials as required.”

    • Staff training and qualifications

Regulation 7.1.2.2: Staff who are counted in the staff/child ratios and auxiliary staff left alone with children and/or counted in staff/child ratio as specified in the rule 6.2.1.8 of these regulations shall obtain training in pediatric first aid and in infant and child CPR within three (3) months of beginning work in the CBCCPP and remain currently certified.

“A review of staff BFIS Quality and Credential accounts and staff files reflected that the Director was not curently certified in infant and child CPR and pediatric first aid. The Director confirmed that he was not currently certified in CPR and first aid as required. Corrective Action: Immediately plan to have the director complete certifications in infant and child CPR and pediatric first aid and submit documentation of those certifications to Northern Lights at CCV (NLCCV) with a cover sheet. If you need assistance locating an approved pediatric first aid and infant and child CPR certification course, you may reach out to your Northern Lights at CCV resource advisor, [name], at 802-828-0621 or joanne.rouleau01@ccv.edu. Develop a system which will prompt you and/ or staff to track their CPR and first aid certifications in a manner which will ensure that each staff becomes certified within three (3) months of hire and remains currently certified.”

    • Records and paperwork

Regulation 3.4.3: A system for taking attendance, including documentation of the time when each child arrives and departs each day he/she attends the CBCCPP, shall be established. The licensee shall save all daily attendance records identifying the hours of children's attendance for at least twelve (12) months from the date that care is provided.

“Children's arrival and departure times were last documented on 1/29/2018, since then attendance has been recorded with a check mark only. Children's arrival times but not departure times were recorded on 1/25/2018, 1/17/2018, and 1/12/2018. Attendance was not recorded 1/18/2018 and 1/19/2018. Corrective Action: Ensure a system is in place to clearly record all children in attendance on a daily basis. Retrain staff in accurately documenting attendance as children arrive and depart. Submit a statement to this Licensor by 3/15/2018 indicating the training has been completed.”
