Staff # 1, Staff # 2 and Staff # 3 had a total of 13 children on the playground. 5 of those 12 children were under the age of two years. The ratio for children 16 months to 24 months is 5 children to 1 staff member. 2. At approximately 10:47 am, there were 12 children on the playground with two staff members. 3. Staff # 1 had taken one child to use the bathroom, leaving Staff # 2 and Staff # 3 with 12 children and out of ratio. 4. Staff # 2 stated that Staff # 1 was gone for approximately one minute.”
