Regulation 5.6.5: All prescription medication administered by staff shall be in its original container, properly labeled for the child, and administered prior to the expiration date on the container.

“An inhaler is stored in a plastic bag with a child's name written on the outside of the plastic. The original packaging is not present and there is no labeling of the medication. Corrective Action: Have the identified medication stored within the original packaging which needs to include the child's name and prescription information.”

Regulation 5.1.2: General Health Examinations: Within forty-five (45) days of enrollment, the licensee shall obtain documentation of the child's age appropriate well care exam from the parent. Documentation shall include information regarding any health conditions and medications that may impact the care of the child.

“In a random sampling, two of the four files for children currently attending care are missing the required general health examinations. Child 1 has been in care since October 2022 and Child 2 has been in care since September 9, 2022. Corrective Action: Have the missing health examinations in the identified children's files by 12/15/2023. Review all other children's files to ensure wellness exams are in place. Send an email to this licensor confirming completeness of all child's file and/or the plan with dates to have each child's file complete.”

Regulation 5.10.1.2.1: The licensee shall ensure that the CBCCPP is in compliance with Vermont Division of Fire Safety rules at all times. This includes but is not limited to: * Complying with Vermont Division of Fire Safety inspection reports; * Having regular fire systems inspected with violations identified during the inspection noted as corrected; and * Having fire extinguishers tagged with valid inspection tags.

“The inspected tags for the fire extinguishers list a date of inspection of August 2021. Program staff did not report nor provide documentation of any inspection date other than the August 2021 date. The inspection tag notes the extinguisher were to be inspected within 1 year of August 2021. Corrective Action: Have the extinguishers inspected and the inspection tag updated. Develop a reminder system to ensure the inspections occur as required. Send the plan for ensuring inspections occur as required by this rule to this licensor.”

Regulation 3.3.5: The licensee, staff, and auxiliary staff shall be trained in prevention, identification and mandatory reporting of child abuse and neglect.

“Program staff have not completed Protecting Vermont's Children from Abuse and Neglect training which is the recognized training that meets the requirements of this rule. Corrective Action: Have all staff persons complete the required training. When sending the certificate of completion to Northern Lights at CCV for uploading to each person's quality and credential account, cc this licensor on the email submissions.”

Regulation 7.2.2: The licensee shall ensure that all new staff and auxiliary staff, prior to working with children in the CBCCPP; and any new individual designated as the representative of the licensee shall submit a Records Check Authorization form to the Division and shall submit to fingerprinting at a location designated by the Division after having received the Fingerprinting Authorization Certificate by the Division.

“A staff person was employed for the June, July, and August of 2021 as a teaching assistant and had not completed the fingerprinting process as required. The program and this individual were notified of the fingerprinting requirement on 05/12/2021. Corrective Action: Establish a system to ensure all new hires in need of fingerprinting follow through on the process in a timely fashion.”

Regulation 3.4.7.5: The licensee shall maintain a current list of the licensee or designee, staff, auxiliary staff, and volunteers as in the rules in section 7.7.5 of these regulations, as applicable in BFIS. Any changes shall be reported through BFIS within five (5) working days of the change.

“The associated parties list has two persons listed with the wrong position titles. It was confirmed that it has been more than 5 business days that each individual has been incorrectly listed. A partner staff person is listed on the associated parties list and has reportedly been know to have left the position that brough the individual into the program. As of the start of the school year, this individual was no longer affiliated with the program. Corrective Action: Contact Childcare Business Technician [name] to update the position titles. Remove the individual no longer associated with the program. Develop a system that identifies who is responsible for maintaning the associated parties list and how that list will be monitored for compliance to the requirements of this rule.”

Regulation 5.2.3.12: The licensee shall post the diaper changing procedure at each diaper changing area.

“The diaper changing procedure was not posted in the program. Corrective Action: Ensure the diaper changing procedure is posted near the designated diaper/pull up changing area.”
