“Based on record review and interview, the center did not obtain out-of-state child abuse and neglect search requests, criminal history records checks, and sex offender registry searches prior to employment. Evidence: 1. The records for Staff #1 and Staff #5 did not contain results of out-of-state criminal history checks. 2. The records for Staff #1, Staff #2, and Staff #5 did not contain the results of an out-of-state sex offender registry search. 3. Staff #1, Staff #2, and Staff #5 indicated living in another state other than Virginia within the last five years on their sworn disclosure statement.”

“Based on record review and interview, it was determined that the center did not ensure that employees that had lived out of the state of VA within the last 5 years have in their files the result of an out-of-state Central Registry search request and an out-of-state Sex Offender Registry search request within 30 days of employment. Evidence: 1) On the date of inspection, the record for Staff #4 (start date 08/31/2020) did not contain the results out-of-state Central Registry ( CPS ) search request and an out-of-state Sex Offender Registry search request. Staff #4 had declared in their sworn statement having lived out of the state of VA within the last 5 years before employment. 2) The center director showed documentation of a written communication dated 09/14/2020 inquiring about the CPS process. Additional follow up or the results of a request were not available for review. According to the center director, a new CPS search request form was mailed recently.”

Evidence: 1) The most recent Central Registry search request results available in the record for Staff #3 were dated 10/04/2014. The director stated that a new Central Registry search has not been requested for Staff #3.”
