    • Records and paperwork

Regulation 6.2.8.4.2: In the event that the concerns cannot be resolved, written notice to the child's parent(s) is required with at least five (5) days' notice prior to expulsion.

“You requested that a family return to child care and pick up their two children that they had dropped off that morning. Based upon your own statements and that of the family, you gave the family one hour to get back to the childcare program to pick up the children. Corrective Action: You must provide 5 days written notice when you are unable to work out differences with families and you are terminating their care.”

    • Supervision and ratios

Regulation 6.2.1.3: The program director shall ensure that the number of staff present meets requirements described in the chart below for ages of children, maximum group size, and staff/child ratios at any time of day.

“You have had one staff person working with a group of more than five children, when at least one of the children is under 32 months in age. This has been happening routinely throughout the winter on Mondays and Fridays of each week. This is a serious violation. Corrective Action: Staff child ratio for a group of children with a child less than 32 months of age can only have five children total. With a child of that age, you must reduce your group size to five children maximum or increase your staffing on Mondays and Fridays. This is a serious violation which requires a Parental Notification Letter.”

    • Records and paperwork

Regulation 3.4.6.5: Staffing Schedule: A licensee shall maintain a written record of the daily schedule for at least 365 days of all staff including exact days and hours worked and the group of children to whom they are assigned.

“You do not maintain a staffing schedule for yourself that captures the exact days and hours and group of children that you work with. Corrective Action: Starting immediately, as the director you must record your own in and out times of working directly with children.”

    • Health, medication and illness

Regulation 5.1.2: General Health Examinations: Within forty-five (45) days of enrollment, the licensee shall obtain documentation of the child's age appropriate well care exam from the parent. Documentation shall include information regarding any health conditions and medications that may impact the care of the child.

“An audit of some child files was conducted and it was found that the program did not have the required general health exams documentation for two (2) out of the three (3) files reviewed. Both children were in care for more than forty-five (45) days. Corrective Action: It is required to review the enrollment files of children in care to ensure all children have the general health exam forms in their file. It is required to develop a tracking system that will be used when children are enrolled to ensure that all required forms are received within the required timeframe after enrollment.”

    • Safe sleep

Regulation 5.4.3.2: Children shall not be required to sleep. Children who do not nap shall be provided space and equipment for quiet play.

“It was determined through staff statements that the program has children lay on their rest mats for 30 minutes or more, without opportunity for quiet activities during that time. It was confirmed that children must lay on the mats for a minimum of 30 minutes, even if they do not nap. This is a violation because children shall be offered the opportunity to have quiet activities during rest if they are not sleeping. Corrective Action: Effective immediately, revise and review the procedures for rest. Submit a statement of agreement and a description of rest practices that addresses how rest procedures will be conducted going forward, that reflects how children will have space and equipment for quiet play.”

    • Staff training and qualifications

Regulation 7.3.1.1: The licensee shall ensure and maintain documentation that the program director is at least twenty-one (21) years of age and meets the qualifications below based on the licensed capacity of the CBCCPP.

“The program is licensed for 18 children. After transcript review of director qualifications, it was determined that the Director has not completed requirements to meet the additional qualifications required for a program licensed for 13 or more children, as stated in rules 7.3.1.3 and 7.3.1.5. This is a violation because it is required to have a 3 credit course in Program Management or Staff Supervision and a 3 credit course in managing an early care and education program that includes budgeting and financial management. Corrective Action: By 03/05/2021, it is required to develop a detailed and specific plan, with timelines that demonstrates how the Director will achieve the required coursework to meet compliance with the Director qualifications for the program. • Discipline and child guidance

Regulation 6.2.7.2: Staff's expectations of children's behavior and responses to children's behavior shall be appropriate to each child's level of development and understanding. Guidance shall be designed to meet the individual needs of each child.

“Staff member X was observed to have placed her legs across a one year old child's body on a cot while the child was crying, after they would not settle for rest time. When asked, Staff Member X admitted that they had placed their legs across the crying child in order to apply pressure to the child. Staff member X did not take additional measures to calm or soothe the child and utilized their cell phone during the interaction. This is not a developmentally appropriate response. Corrective Action: Effective immediately, only appropriate and positive rest time and guidance interactions will be used with children in care. A program improvement plan outlining the program's policies on rest time and appropriate interactions will be submitted to this licensor. By 10/21/2019 the plan will be sent to this licensor for review.”
