Regulation 2.3.10.5: The FCCP shall be responsible for compliance with all applicable state and federal laws even when they are more stringent than the rules in this set of FCCH regulations.

“A memorandum sent out to all licensed programs on July 30, 2019, states that due to federal requirements, all staff, as defined by regulation, shall obtain training in pediatric first aid and infant and child CPR within 3 months of employment and remain currently certified. A review of staff BFIS accounts and staff files reflected that Staff A, who had been on the staff list for more than 3 months, was not currently certified in infant and child CPR and pediatric first aid as required. While the provider stated that Staff A had not yet substituted in her program, she also stated that Staff A may be utilized as a substitute at any time. Corrective Action: Immediately plan to have Staff A complete an approved pediatric first aid and infant and child CPR certifications.
