    • Staff training and qualifications

Regulation 3.4.7.3: Within six (6) months of the initial date of employment; staff and auxiliary staff left alone with children and/or counted in staff/child ratio as specified in the rule 6.2.1.8 of these regulations, and the program director shall maintain an up-to-date BFIS Quality and Credential Account. Documentation, verification of qualifications, and all annual professional development activities as specified in the rules in sections 7.3 and 7.4 of these regulations shall be submitted to Northern Lights at CCV to be verified and maintained in BFIS.

“Three staff members who have worked at the program for more than 6 months do not have up to date BFIS accounts. The program has not submitted documents needed to assess position qualifications for all 3 staff. The program has not provided documentation of valid CPR and FA certification for all 3 staff. These documents were available on site. This is a repeat violation cited on 01/31/2020. Corrective Action: This regulation requires that within 6 months of hire all staff have an up to date quality and credential BFIS account. Please submit required documentation to Northern Lights at CCV. A copy of the professional development cover sheet and email address for Northern Lights was provided in a seperate email. This is a repeat violation and will require a program improvement plan. This program improvement plan will be sent to this licensor and will include a description of a system that will be put in place during the onboarding of new staff to ensure required documents are sent to BFIS within 6 months of hire. This plan shall identify the individual or individuals who will ensure future compliance with this regulation.”

    • Background checks

Regulation 7.2.1: The licensee shall ensure that any new individuals regularly present at the CBCCPP submit a Records Check Authorization form to the Division prior to working with children in the CBCCPP.

“Three staff members were observed working with children at the program and they were not listed on the program's associated parties list. Through a conversation with Staff A it was determined that these staff have been regularly at the program and record check authorization forms have not been submitted for them. Corrective Action: Immediately submit record check forms for the 3 staff identified during the visit as not having submitted record check forms. Please email this licensor when those record check forms have been submitted. The program has been advised that these forms must be emailed and not mailed. • Building, equipment and play areas

Regulation 5.10.3.3: Safe Use Zones For all play equipment that is thirty (30) inches or higher from the ground, including climbing equipment, slides, swings and other similar equipment, the licensee shall ensure that the surface under and around the equipment, including recommended use zones, is of approved resilient material that protects children if they fall. * Materials in the use zone shall consist of wood chips, pea stone, mulch, engineered wood fibers, sand, safety-tested shredded or rubber like material or rubber mats designed for protective cushioning; * Materials used in the use zone shall follow the recommendations listed in the most recent publication of U.S. Consumer Product Safety Commission's Public Playground Safety Handbook regarding critical depth of tested materials determined by the height of the highest climbing surface of the equipment; * Materials used in the use zone shall be installed and maintained according to the manufacturer's instructions; * If the loose material such as sand, mulch, or shredded rubber is used in use zones, the licensee shall ensure that the material is raked regularly and replenished to maintain depth and resilience; and * If the resilient material in use zones freezes, staff shall ensure that children will not play on the equipment until the resilient material has thawed and is once again resilient.

“The area around the swing set did not contain the required depth of cushioning material. This lack of depth was not due to the cushioning material being spread too thin. It appears that new cushioning material has not been added to the area at any time recently. The ground around the swing contained what appeared to be disintegrated bark mulch and possibly some pea stone. The ground around the swing was firm and even if this was not a cold day the ground itself would still be firm due to the condition of what was left of cushioning material. Children were utilizing the swingset during the visit. Corrective Action: Children may not use the swingset until new cushioning material is added to the fall zone area for the swingset. Please refer to the most recent copy of the U.S Consumer Product Safety Commission's Public Playground Safety Handbook to ensure the correct depth of cushioning material is added. Please send this licensor a photo once the cushioning material is in place.”

“At the time of the visit there were 3 individuals listed on the program's associated parties list in BFIS who are no longer present at the program. Those individuals have not been at the program for more than 5 working days. The program's hours and days of operation were also not current and listed that the program only operates on Monday and Tuesday. The program operates Monday-Thursday. Regulation 5.10.3.2.3: The licensee shall ensure that large outdoor play equipment is anchored firmly in accordance with manufacturers' specifications, is not located on concrete or asphalt surfaces and is placed so as to accommodate manufacturers' specifications for use zones.

“During the visit this licensor observed that the front right wooden support beam that goes into the ground (right side if looking at the swingset as you exit the building) was coming up out of the ground approximately 4 inches when the children were using the swings. This issue was noticed by the children and the children asked Staff B if she could please lean on it so the swingset would stop wobbling. Corrective Action: The swingset is currently not adequately anchored into the ground. The swingset shall not be used until this issue is fixed.
