Regulation 2.3.9.5.4: The FCCP shall ensure that a drinking water system serving less than twenty-five (25) persons daily, served by their own well or spring, is chemically tested for arsenic, uranium, nitrite, manganese, and fluoride once every six (6) years. This testing shall be analyzed by a Drinking Water Laboratory certified by the State of Vermont according to 18 V.S.A. S501b. * Results shall meet Vermont standards. Water shall be remedied and retested to ensure potability if any test(s) are elevated. * Bottled water for drinking shall be provided until such time as the drinking water system meets Vermont standards. * The sample shall be a representative sample from the tap most frequently used for drinking after any treatment (for example a UV light system, a softener or charcoal filter). * Information from these water tests shall be included in the license renewal.
“Upon review of the Provider's BFIS account it was identified that during the licensing renewal process in 2023, the provider was required to submit to water testing as required by this rule. The provider confirmed via email that such testing had not been conducted since 2017. Corrective Action: Immediately discontinue use of the household water system for consumption. Bottled water must be utilized for drinking until test results have been provided to the Divison certifying that the water is potable. Connect with the Vermont Dapartment of Health for guidance in completing water testing. In addition, develop a system to ensure that the drinking water system is chemically tested as required by this rule moving forward. In the corrective action email provide details of the system developed to ensure compliance moving forward, including how knowledge of deadlines will be maintained.”

“Upon review of information from the Vermont Department of Health it was identified that this Provider has not tested for lead in drinking water since 2019. Based on Vermont standards testing was required to be conducted in 2022. Provider statements reflect they did have correspondence with the Vermont Department of Health and received a lead water testing kit, but that samples have not yet been drawn or sent to a laboratory. Corrective Action: By 02/14/2025 ensure that the directions provided with the lead water testing kit are followed and that the water samples be provided to a Vermont Deparment of Health Laboratory. Provide updates to Licensor [name] throughout the testing process. In addition, develop a system to ensure that lead water testing is conducted as required by the Vermont Department of Health moving forward. In the corrective action email provide details of the system developed including how you will maintain knowledge of deadlines in which testing must be completed.”
