OCCL Standards Complaint (Substantiated)
“The Office of Child Care Licensing (OCCL) received a complaint on March 15, 2023, regarding improper staff-to-child ratio and inaccurate attendance records. An investigation was conducted on March 21, 2024. This complaint was substantiated for improper staff-to-child ratio because according to the attendance records from March 14, 2024, there were two staff members in the opening classroom, with up to 13 children from 6:48 am to 7:15 am, the youngest being an infant. In the two-year-old room, there was one staff alone with nine children from 7:43 am until 7:45 am and one staff with up to 10 children from 8:45 until 9:05 am. This complaint is substantiated for inaccurate attendance records because there were two children signed in at 6:54 am and 6:55 am but signed out of the room at 6:45 am. In the preschool room, there was one child signed in at 6:56 am but signed out of the opening room at 6:45am. A concern noted was unqualified staff were being left alone with children. Non-Compliance Cited: Reg #27: Ensure proper staff-to-child ratio and maximum group size are maintained at all times. According to attendance records, the opening classroom was over staff-to-child ratio and maximum group size on March 14, 2024, with two staff members and up to 13 children, the youngest being an infant, from 6:48 am until 7:15 am. “The Office of Child Care Licensing (OCCL) received a complaint on October 25, 2022, regarding improper staff-to-child ratio. An investigation was conducted on November 7, 2022. The complaint is substantiated for improper staff-to-child ratio because the specialist observed Staff #3, an aide without criminal history eligibility determination, alone with eight one-year-old children. According to attendance records for the morning, Staff #4 was alone with up to 14 children until 7:29 a.m., the youngest was three-years-old. Two staff had up to 11 children until 7:00 a.m., the youngest was an infant. An additional concern noted was a classroom being over capacity because the specialist observed 19 four-year-old children in a classroom with a capacity of 14 children. Additionally, in this classroom, cots were not 18 inches apart because there was not enough space due to the room being over capacity.”
