      OCCL Standards Complaint (Substantiated)

“The Office of Child Care Licensing (OCCL) received a complaint on May 4, 2023, regarding unqualified staff members being alone with children, improper discipline, inappropriate adult behavior, not meeting the needs of all children, lack of sanitation, and improper storage of food. An investigation began on May 9, 2023, and was completed on May 16, 2023. This complaint is substantiated for not adapting care for children with special needs. Child #1 was observed strapped into a stroller that was not age-appropriate and interviews with staff members confirmed this occurred for long periods of time. Staff members were not observed interacting with Child #1 and the center stated they did not have a copy of Child #1 s IEP to adapt their program to his needs. There is no evidence to substantiate a fifteen-year-old staff member working alone with infants, as it was not observed and not shown on staff attendance records. All staff interviewed denied this allegation occurred. There is no evidence to substantiate allegations of improper discipline because the staff members interviewed denied witnessing other staff members hitting or plucking children in care or denying food or drink as discipline. There is no evidence to substantiate inappropriate adult behavior because staff members interviewed stated they did not observe this at the center. There is no evidence to substantiate concerns about sanitation, as the staff members interviewed stated the center has a company hired to clean every night, and toys and equipment are cleaned as required in the classrooms. The ceilings were not observed to be in disrepair. There is no evidence to substantiate improper storage of food, as all staff members stated food is served to the children as soon as it is ready. The following additional concerns were noted during this investigation. On May 9, 2023, sixteen children with the youngest being a one-year-old, were observed in one room with two staff members. Classroom attendance documen tation was inaccurate at the time of the visit. Attendance documentation received for the infant room showed Staff #7 began employment prior to being determined eligible. The menus posted in the kitchen and classrooms were dated March 13, 2023. Two infants were observed sleeping in pack-n-plays with bibs and pacifiers clipped to their bibs as well as loose-fitting sheets. An infant was observed drinking from a sippy cup while in a pack-n-play. There was no documentation on file for a child with an Individualized Educational Plan (IEP). On May 16, 2023, a follow-up visit was conducted and infants were observed in pack-n-plays with no sheets and with bottles present. Additionally, there were no daily logs or infant feeding schedules completed for infants in care. Tight-fitting sheets were placed in the pack-n-plays at the request of this specialist.”
