      8VAC20-780-70

“Staff records shall be kept for each staff person, to include the staff person's name, address, verification of age, job title and date of employment; and name, address and phone number of a person to be notified in an emergency, background checks and health information. There was no documentation of a completed Sworn Disclosure Statement (SDS) on-file for Staff #1. There was no staff record on-site for Staff #2 that documented the staff person's name, address, verification of age, job title and date of employment; and name, address and phone number of a person to be notified in an emergency. Management was unable to provide documentation of a TB screening for Staff #2 and did not know if a current TB screening existed. Additionally, there was no documentation of a completed Sworn Disclosure Statement (SDS) on-file for Staff #2. Management reported extenuating circumstances that are preventing them from accessing some staff records for an undetermined amount of time”
    • Records and paperwork

      8VAC20-780-80-A

“For each group of children, the center shall maintain a written record of daily attendance that documents the arrival and departure of each child in care as it occurs. On 3/30/26, the written record of daily attendance (defined by the program as the attendance accountability checklist), was inaccurately completed by Staff #1, documenting that Child #1, a 5-year-old, had been picked up by a parent. The child never departed and was left unsupervised on the community playground for 30 minutes. No staff visually saw the child depart. In a written statement, Staff #1, who was the only staff with an attendance accountability checklist, stated that he positioned himself on the parking lot side of the playground to serve as the point of contact for arriving parents, and as parents arrived he would call the child over and walk them to the parent for dismissal.”
    • Supervision and ratios

      8VAC20-780-340-A

“When staff are supervising children, they shall always ensure their care, protection, and guidance. On 3/30/26, when Staff #1 and #2 were supervising Child #1, a 5-year-old, on the community playground they did not ensure the child's care and protection when staff were unaware that the child was left unsupervised and marked by staff as having departed for the day. Staff were unaware of the child's whereabouts until the parent arrived to pick the child up. The playground is used by the community on a daily basis and is not closed to the public when the SACC program is operating. When interviewed, Child #1 stated that during the time he was not supervised he was playing with a stranger he met that day on the playground.”
    • Supervision and ratios

      8VAC20-780-340-F

“Children under 10 years of age shall always be within actual sight and sound supervision of staff. On 3/30/26, Child #1, a 5-year-old, was not maintained in sight and sound supervision by staff. As observed on video footage, from 5:17-5:47pm, Child #1 was left unsupervised on the community playground when Staff #1 and #2 went inside the community center and entered the child care room. The program's classroom does not have a view of the playground. [Refer to Photos #1, #2 and #3.]”
    • Other rules

      8VAC20-780-40-E

“The operational responsibilities of the licensee shall include ensuring that the center's activities, services, and facilities are maintained in compliance with these standards, the center's own policies and procedures that are required by these standards, and the terms of the current license issued by the department. The center's policies and procedures for identifying where attending children are at all times, playground supervision, and for the departure of children state the following: -That each staff will ensure the care, protection, guidance and sight and sound supervision of all children at all times, by accounting for the children in their care on their attendance accountability checklist before transitioning to another location; -Each staff will also record departure information, name-to-face will be conducted periodically to visually verify each child is present; -Visually verify that all children have left the area before moving to the next location, all programs areas and outdoor spaces will be checked; -Children must be signed out by an authorized person at the time of departure and a visual check of the child completed; -Staff will report any attendance discrepancies to the supervisor immediately, and staff assigned to the main pick-up location (in the building) will be responsible for the master center attendance accountability checklist. On 3/30/26, each staff did not account for children and their departure on their own attendance accountability checklist. A child was marked as departed for the day without a visual check of the child departing with an authorized person. Periodic name-to-face checks were not completed. A visual check of the playground area was not completed before leaving to go inside the center, resulting in Child #1, a 5-year-old, being left alone unsupervised on the playground. Though attendance discrepancies were noticed by staff while on the playground, they did not report them to the supervisor. The master center attendance accountability checklist (in the building) was not used to track when children departed for the day.”

      8VAC20-780-40-E

“The operational responsibilities of the licensee shall include ensuring that the center's services are maintained in compliance with these standards and the center's own policies and procedures that are required by these standards. No staff ensured compliance with licensing standards and SACC mandated reporting policies/procedures when delaying a report of suspected abuse to child protective services ( CPS ) for over 48-hours after receiving the allegations from a parent. During the 48-hour time period of when the allegations were reported to SACC staff and when SACC staff reported the allegations to CPS (9/22/25-9/24/25), Staff #2, on 9/22/25, reported to the regional manager, Staff #5, the plans to interview Staff #1, #3 and #4, about the allegations. Staff #5 reportedly attempted to contact another program manger, Staff #6, to discuss the allegations but was unsuccessful in reaching them and told Staff #2 to "use your judgement" in deciding as to whether to report the allegations to CPS . On 9/24/25, at 8:37am, Staff #2 filed an incident report within the SACC reporting system that included the allegations made and interviews conducted. Also on 9/24/25, Staff #1 was transferred to work at a SACC administrative office due to the allegations made. Staff #2 reported that they are told to "get the stories first" before reporting to CPS and questioned SACC training and policy being inconsistent with the mandated reporting requirements. The SACC mandated reporting written policy states that staff are to report suspected abuse and neglect "as soon as possible but no later than 24 hours after having a suspicion of a reportable offense."”
