AAC R9-3-301.A.3.a. A. A certificate holder shall: 3. Ensure that each resident 12 years of age or older and each staff member submits, on or before the starting date of residency, employment, or volunteer services, one of the following as evidence of freedom from infectious active tuberculosis: a. Documentation of a negative Mantoux skin test or other tuberculosis screening test recommended by the U.S. Centers for Disease Control and Prevention, administered within 12 months before the starting date of residency, employment, or volunteer service, that includes the date and the type of tuberculosis screening test; or b. If the resident or staff member has had a positive Mantoux skin test or other tuberculosis screening test, a written statement that the resident or staff member is free from infectious active tuberculosis that is signed and dated by a physician, physician assistant, or registered nurse practitioner within six months before the starting date of residency, employment, or volunteer service; and

“Findings: Compliance Officer 2 reviewed the personnel file for Staff 1 and found that she filled out the TB affidavit for centers only and did not get a TB test required per group home rules.”

AAC R9-3-405.A.2. A certificate holder shall ensure that a staff member: 2. Teaches, models, and encourages orderly conduct, selfcontrol, and age-appropriate behavior;

“Per allegation and based on an interview with the Provider and staff members, the Compliance Officers found the following: * The Provider acknowledged that she did spray a child with water due to the child not behaving. The child was sprayed no more than 10 times with the water bottle. * The staff have made children run a lap around the backyard as a means of redirection to let off steam and to think about their actions. The staff do run around the yard with the children and also use it as an opportunity to get in some exercise.”
