The plastic swing set with attached slide lacked any cushioning material. 2. A small little tikes half cube with attached slide was placed over grass. a. Grass does not meet the definition of cushioning material.”

“Based on observation, the center failed to maintain sand or other cushioning material under playground equipment. Evidence: 1. During a virtual review of the outdoor play area on 11/01/2021, the inspector reviewed a variety of outdoor play equipment including but not limited to, a set of swings, a little tikes play structure and two small climbing cubes with slides. None of these pieces of play equipment had cushioning material under and around them. a. A child falling or jumping from any of the outdoor play equipment could sustain an injury.”
